تناولت هذه الدراسة المسؤولية الدولية لمنظمة الصحة العالمية في منع انتشار الأوبئة، وجاءت هذه الدراسة لإبراز اشكالية المسؤولية الدولية لمنظمة الصحة العالمية في ظل اعتمادها على الدول الاعضاء في عملية التمويل، وعدم وجود تمويل كافي مقارنة بالالتزامات الواقعة على عاتقها. وتكمن اهمية هذه الدراسة في بيان دور منظمة الصحة العالمية في التصدي للأوبئة والالتزامات المترتبة عليها وبيان المسؤولية الدولية للمنظمة والاساس الذي تقوم عليه، اضافة الى الاثار المترتبة على هذه المسؤولية وبيان الية الاحتجاج بمسؤولية المنظمة ووسائل تسوية منازعاتها. واعتمدت الدراسة المنهج الوصفي بالأسلوب التحليلي من حيث وصف المشكلة بأبعادها وتحليلها بهدف توضيح المسؤولية الدولية للمنظمة من خلال عرض المعاهدات الدولية التي تناولت موضوع مسؤولية المنظمات الدولية. وقد خلصت الدراسة الى جملة من النتائج اهمها اعتماد تمويل منظمة الصحة العالمية على المساهمات المحدودة من الدول الاعضاء، وعدم وجود تمويل محدد وكافي لمنظمة الصحة يبقيها تحت سيطرة الدول الاعضاء مما يؤثر على استقلاليتها ويعرضها للضغوط اثناء ممارسة عملها، الأمر الذي يؤدي إلى ضعف الآليات التي تستطيع استخدامها في ضمان حماية الحق في الصحة والحماية من انتشار الأوبئة العالمية |

This study addressed the international responsibility of the World Health Organization in preventing the spread of epidemics, and this study came to highlight the problem of the international responsibility of the World Health Organization in light of its dependence on member states in the financing process, and the lack of sufficient funding compared to the obligations placed on it. The importance of this study lies in clarifying the role of the World Health Organization in combating epidemics and the obligations resulting from it, and explaining the international responsibility of the organization and the basis on which it is based, in addition to the implications resulting from this responsibility and explaining the mechanism for invoking the organization?s responsibility and the means of settling its disputes. The study adopted the descriptive approach with the analytical method in terms of describing the problem with its dimensions and analysis with the aim of clarifying the international responsibility of the organization through presenting the international treaties that dealt with the subject of the responsibility of international organizations. The study concluded with a number of results, the most important of which is the dependence of the World Health Organizations funding on limited contributions from member states, and the lack of specific and sufficient funding for the Health Organization that keeps it under the control of member states, which affects its independence and exposes it to pressure while carrying out its work, which leads to the weakness of the mechanisms that can be used to ensure the protection of the right to health and protection from the spread of global epidemic |
