الملخص بالعربية
تهدف هذه الدّراسة إلى معرفة أثر الخلاف في حجية الاستصحاب على الفتوى عند الفقهاء في باب الطلاق، وإظهار مدى الخلاف على تطبيق المسائل الفقهية في المذاهب الفقهية. أن الاستصحاب من الأدلة المختلف فيها عند فقهاء المذاهب الإسلامية، فما أحوج ما يكون إلى التفرقة بين المناهج.. مما أدى إلى تضارب الفتوى لديهم فمنهم من يعمل بالاستصحاب بشكل مقيد ومنهم من يعمل به بشكل مطلق وقِلة لا يعملون به. وقد استخدم البـاحث فـي هـذه الدراسـة المنـهج الاستـقرائي والتحـليلي والاسـتنباطي، مـن خـلال دراسة الإشكاليات، نقداً واستنباطاً في القضايا الفقهية المتعلقة بالاستصحاب عند الفقهاء. وقد جاءت هذه الدّراسة في مقدّمة وفصلين، حيث تناولت الحديث عن الاستصحاب مفهومه وحجيته والاستثناء والآراء عن الفقهاء، بالإضافة لذكر تطبيقات فقهية تتعلق بالاستصحاب في باب الطلاق

 This study aims to know the impact of the dispute in the authenticity of the companionship on the fatwa of jurists in the chapter on divorce, and to show the extent of disagreement on the application of jurisprudential issues in the schools of jurisprudence. Istishhab is one of the controversial evidences of Islamic sects, so there is no need to differentiate between curricula. Which led to the conflict of their fatwa, some of them work in the companionship in a restricted manner, some of them work in it absolutely, and a few do not work with it. In this study, the researcher used the inductive, analytical and deductive approach, through the study of problems, critically and deductively in the jurisprudential issues related to the companionship of jurists. This study came in an introduction and two chapters, where it dealt with talking about the concept and authority of the companion, the exception and opinions of the jurists, in addition to mentioning jurisprudential applications related to the companionship in the chapter on divorce
