الملخص بالعربية |
اشتملت الدراسة على توضيح مصطلحات العنوان، وبيانٍ بمقدمة لما يتعلق بتلك المصطلحات، وأسباب العدول عن الأصل وتوضيحها بشرح يسير.
وتدور مشكلة الدراسة حول بيان الأصل والاستثناء في الفروع الفقهية، وكيفية توافقهما مع مقاصد الشريعة، حيث بيّنتُ في كل مسألة الأصل والاستثناء منه، ومقصد الشارع فيه، فمنه ما وجدتُ نصا للفقهاء في مقصده، وما لم أجد؛ استخرجته اعتمادًا على ما تبيَّن لي منه مِن خلال فهمي وبحثي لإنجاز هذه الدراسة.
وخُصَّت الدراسة في باب العبادات في المذهب الشافعي، وقد استقرأت في أبواب العبادات من كتب المذهب ما تيسر لي، وكانت المسائل في الطهارة والصلاة والصوم والزكاة والحج، على تفاوت بعدد المسائل في كل باب، لكنها تحقق مقصود الدراسة -إن شاء الله تعالى-.
وتوصلتْ هذه الدراسة إلى نتائج أهمها: إنَّ الأحكام الشرعية جميعًا؛ شُرعت لمصلحة المكلف، سواء أدرك تلك المصلحة أم لا، وأن الأصل والاستثناء كل منهما خطاب الله للمكلف، فكلاهما حكم شرعي، وأن الاستثناء لا يكون دائما رخصة، وتعتري الاستثناء الأحكام التكليفية بحسب حال المكلف، والله تبارك وتعالى أعلم.

الملخص بالانجليزي |
This study attempts to explain both the Normative Principle Rule and the Exception to the Rule in the branches of jurisprudence, and how they are compatible with the Objectives of Shariah Law. Each topic explains the Principle Ruling and the exception to it, beside the legislator?s objictive concerning the above mentioned aim.furthermore a deduction was made when no legislator?s objictive was found
The study focuses on acts of worship in the Shafi?i doctrine. a good research was done regarding this doctrine, adressing the topics of purity, prayer, fasting, Zakat, and Hajj, , in attempt of fulfilling the purpose of the study.
This study includes clarification of the terms of the title, an introduction to what relates to those terms, and the reasons for departing from the original meanings and clarifying them with an explanation.
The study concludes the following:
- all legal rulings were legislated for the benefit of the legally responsible individual, whether one realized that benefit or not.
- the Normative Principle Ruling and the exceptions are both God?s order to the legally responsible individual, thus they are both valid legal rulings.
- the exception is not always considered as a license .
- the exception applies to the mandated rulings according to the situation of the legally responsible individual .
