تهدف هذه الدراسة إلى التعرف على أهمية تمويل التحكيم من قبل الغير، واستعراض أبرز أساليب هذا التمويل المتاحة للأطراف المشاركة في إجراءات التحكيم، بالإضافة إلى تحليل أثر نقص التمويل من قبل الغير على سير العملية التحكيمية.
وتبرز مشكلة الدراسة من خلال رفض بعض الجهات لتبنّي فكرة تمويل التحكيم من قبل طرف ثالث، وذلك لأسباب متعددة تتعلق بالنزاهة، والاستقلال، والخصوصية. فمن أبرز التحديات أن وجود طرف ممول خارجي قد يحدّ من سرية وخصوصية الإجراءات التحكيمية، نظراً لاطلاعه على تفاصيل القضية رغم عدم كونه طرفاً مباشراً فيها. ولهذا، تسعى الدراسة إلى توضيح طبيعة هذا النوع من التمويل وآثاره القانونية المحتملة.
وقد توصلت الدراسة إلى عدد من النتائج، من أبرزها أن تمويل التحكيم من قبل الغير بات يشكل وسيلة فعالة لتعزيز قدرة الأطراف المتنازعة على الوصول إلى العدالة، وساهم في تقليل الفجوة المالية بين الأطراف، إذ يمنح الطرف الأقل قدرة مالية فرصة متساوية للدفاع عن حقوقه والمشاركة الفعالة في إجراءات التحكيم. وبناءً على ذلك، أوصت الدراسة بضرورة وضع إطار قانوني وتنظيمي موحّد لتمويل الطرف الثالث في التحكيم الدولي، بما يضمن النزاهة والشفافية في هذا النوع من التمويل

This study aims to explore the significance of third-party funding in arbitration and to review the main methods available for such funding to the parties involved in arbitration proceedings. It also seeks to analyze the impact of the absence of third-party funding on the conduct of arbitration.
The problem of the study emerges from the reluctance of some entities to adopt the concept of third-party funding due to various concerns related to integrity, independence, and confidentiality. One of the key challenges is that the involvement of an external funder may compromise the confidentiality and privacy of arbitration proceedings, as the funder gains access to case details without being a direct party to the dispute. Accordingly, this study seeks to clarify the nature of this type of funding and its potential legal implications.
The study reached several findings, most notably that third-party funding in arbitration has become an effective tool for enhancing access to justice for disputing parties. It helps reduce the financial gap between parties, offering the less financially capable party an equal opportunity to defend their rights and actively participate in arbitration proceedings. Based on these findings, the study recommends establishing a unified legal and regulatory framework for third-party funding in international arbitration to ensure transparency and fairness in such funding arrangements
