تناولت هذه الدراسة الاختيارات الفقهية للحافظ ابن حجر العسقلاني في كتابه فتح الباري كتابي "الشهادات والأيمان" دراسة فقهية مقارنة، لإبراز مدى اهتمام الفقهاء بالاجتهاد الفقهي المنضبط وعدم التعصب لمذهب أو التحلل منه، وإبراز أهمية كتاب فتح الباري وصاحبه ابن حجر العسقلاني ، وبيان شروط الاختيار الفقهي المنضبط وأهميته وعلاقته بتحقيق مقاصد الشريعة الإسلامية ، وإبراز أهم الاختيارات الفقهية لابن حجر العسقلاني في كتابي "الشهادات والأيمان"، وبيان حكم كل اختيار فقهي عند المذاهب المعتمدة، وأنها جاءت لتحقيق مصالح العباد وإيصال الحقوق لأصحابها والنفع للمجتمعات الإسلامية.
ولتحقيق أهداف هذه الدراسة استخدم الباحث المنهج الاستقرائي، والمنهج التحليلي، والمنهج المقارن، حيث اقتصرت هذه الدراسة على بيان أهم الاختيارات الفقهية للحافظ ابن حجر العسقلاني في كتابه فتح الباري في كتابي "الشهادات والأيمان".
وتوصل الباحث إلى أنّ الفقه الإسلامي اهتم بالاجتهاد الفقهي المنضبط وبيان أهميته وعلاقته بمقاصد الشريعة الإسلامية، وأن كتاب فتح الباري من أهم وأفضل كتب الشروح التي جمعت بين الفقه والحديث واللغة معا، ونظراً لأهمية الشهادة واليمين في الإثبات تناولت هذه الدراسة كتابي "الشهادات والأيمان" وإبراز اختيارات الحافظ ابن حجر فيها وأثرها على الواقع المعاصر.
ويوصي الباحث طلاب العلم بتحرير كنوز الحافظ ابن حجر العسقلاني وإتمام استخراج اختياراته الفقهية من كتابه فتح الباري من باقي الأبواب، ووضعها في كتاب مستقل مقارنةً بالمذاهب المعتمدة بعد تصنيفها على الأبواب الفقهية؛ لتكون مرجعاً علمياً لمن بعدهم وذخراً لهم

This study dealt with the jurisprudential choices of al-??fi? Ibn ?ajar al-?Asqal?n? in his book Fat? al-B?r?, in the two books of ?Testimonies and Oaths?, a comparative jurisprudential study, to highlight the extent of the interest of jurists in disciplined jurisprudential ijtihad and not being fanatical about a school of thought or abandoning it, and to show the importance of the book Fat? al-B?r? and its author al-??fi? Ibn ?ajar al-?Asqal?n?, and to clarify the conditions of disciplined jurisprudential choice and its importance and its relationship to achieving the purposes of Islamic law, and to show the most important jurisprudential choices of al-??fi? Ibn ?ajar al-?Asqal?n? in the two books ?Testimonies and Oaths?, and to clarify the provision of each jurisprudential choice according to the approved schools of thought, and that it came to achieve the interests of the servants and deliver rights to their owners and then to achieve benefit for Islamic societies.
To achieve the objectives of this study, the researcher used the inductive method, the analytical method, and the comparative method. This study was limited to stating the most important jurisprudential choices of al-??fi? Ibn ?ajar al-?Asqal?n? in his book Fat? al-B?r? in the books ?Testimonies and Oaths.?
The researcher concluded that Islamic jurisprudence is keen on disciplined jurisprudential ijtihad, showing its importance and its relationship to the objectives of Islamic law, and that the book of Fat? al-B?r? is one of the most important and best books of commentaries which combine jurisprudence, hadith and language together. Accordance to the importance of testimony and oaths in proof, this study addressed the books ?Testimonies and oaths? and highlighted on the choices of al-??fi? Ibn ?ajar in them and their impact on contemporary reality.
The researcher recommends the students of knowledge to complete extraction of the scientific treasures of al-??fi? Ibn ?ajar al-?Asqal?n? and to highlight on his jurisprudential choices from his book Fat? al-B?r? in the other chapters, and place them in an independent book compared to the approved schools of thought after classifying them according to the jurisprudential chapters; so that they may be a scientific reference for those who come after them and a source of pride for them |
