الملخص بالعربية |
تهدف هذه الدراسة الى بيان أحكام العلاقة الجنسية على فراش الزوجية وبيان الأحكام التبعية المترتبة عليها واتبعت في دراستي هذه المنهج الاستقرائي التحليلي والمنهج المقارن وقسمت هذه الدراسة لتمهيد وفصلين، يبين في التمهيد عن النظرة العامة عن الزواج والأسرة، وتعريف الفراش لغة واصطلاحاَ والمفردات ذات الصلة به وآداب الجماع وآداب الاغتسال، وتناولت في الفصل الأول أحكام العلاقة الجنسية على فراش الزوجية في الفقه الإسلامي التي اشتملت على الحكم الاصلي والعارض والمباحات، والمحرمات، والمحرمات بسبب الجماع وهيئات الجماع وحكم وطء الزوجة في الحيض وحقوق الزوجين في فراش الزوجية وحقوق الزوج بالفراش حقوق الزوجة بالفراش ومسقطات حق الزوج والزوجة في الفراش، وفي الفصل الثاني تكلمت عن الأحكام التبعية المترتبة على فراش الزوجية في الفقه الإسلامي واشتمل على الاحكام التابعة لفراش الزوجية والعدة (للمرأة وللرجل) وثبوت النسب والمهر وحق الحضانة والجماع في طلاق رجعي والظهار والإيلاء واللعان وصفة الإحصان والبلوغ والإفاقة وأثره على عقد الزواج والأحكام التبعية في فراش الزوجية والاحكام التبعية قبل العلاقة الزوجية وحكم الامتناع للزوج والزوجة، وما هي الأضرار، متى يجوز للزوجين الامتناع وحكم الجماع مع الأمراض المعدية وحكم التزين للرجل والمرأة وحكم المرأة التي لا شهوة لها والأحكام التبعية أثناء العلاقة الزوجية من الشذوذ الجنسي والانزال بيد المرأة (العزل) وحكم اغتسال الزوجين معا.
وتبين للباحث بعد إستقراء الأحكام الخاصة بفراش الزوجية من أحكام للعلاقة الجنسية على فراش الزوجية، وأحكام تبعية مترتبة على فراش الزوجية أن الإسلام قد وضع ضوابط وتعاليم مهمة ومنضبطة بالأحكام الخاصة بفراش الزوجية.

This study aims to clarify the provisions of sexual relations in the marital bed and to explain the consequential provisions resulting from it. In my study, I followed the inductive, analytical and comparative approaches. This study was divided into a preface and two chapters. The preface explains the general view of marriage and the family, the definition of the bed linguistically and terminologically, and the vocabulary related to it and etiquette. Intercourse and bathing etiquette. In the first chapter, I dealt with the provisions of sexual relations. On the marital bed in Islamic jurisprudence, which included the original and incidental rulings, the permissible things, the forbidden things, the forbidden things due to intercourse and the forms of intercourse, the ruling on intercourse with the wife during menstruation, the rights of the spouses in the marital bed, the rights of the husband in the bed, the rights of the wife in the bed, and the omissions of the husband and wife?s right to the bed. In the second chapter, I talked about the ancillary rulings arising from the marital bed in Islamic jurisprudence. It included the rulings related to the marital bed, the waiting period (for a woman and a man), establishing lineage, dowry, the right of custody, intercourse in a revocable divorce, zihar, loyalty, curse, the description of chastity, puberty, and recovery, and its effect on the marriage contract, and the ancillary rulings in the marital bed. And the consequential rulings before marital relations, and the ruling on abstinence for the husband and wife, and what are the harms, when is it permissible for spouses to abstain, and the ruling on intercourse with contagious diseases, and the ruling on adornment for men and women, and the ruling on a woman who has no desire, and the ancillary rulings during a marital relationship, such as homosexuality and ejaculation with the woman?s hand (isolation), and the ruling on ablution for spouses. together., the ruling on a woman who has no desire, and the ancillary rulings during a marital relationship such as homosexuality, ejaculation with the woman?s hand (isolation), and obscene language during marriage.
