تناولت الدراسةُ موضوعَ الإنابةِ القضائيّةِ؛ لِما لهذا الموضوعِ من أهمّيةِ في سيرِ مُجرياتِ المُحاكَمَةِ في المَحاكمِ الشرعيّةِ، وَهَدَفتِ الدراسةُ إلى إظهار أهميّةِ الإنابةِ القضائيّةِ ودورُها في إحقاق الحقِّ منِ خلالِ التّسهيلِ على الأطرافِ المُتنازعةِ في إثباتِ حُجَجِهم أمامِ القضاءِ. وقد اعتمدَتِ الدراسةُ على المنهجِ الاستقرائِي، والمنهجُ الوصفي، بالإضافةِ للمنهجِ التحليلي، وذلكَ منِ خلالِ تتبُّعِ المواد القانونيّةِ ذاتِ الصلةِ ومحاولة استقراءِ جميعِ الإناباتِ القضائيّةِ المعمولِ بِها في المحاكمِ الشرعيّةِ، ومن ثُمَّ وصفها وتحليلها.
وقد جاَءت هذهِ الدراسةُ في مقدمةِ وثلاثةِ فصولٍ، تناول الفصلُ الأولُ ماهيّةَ الإنابةِ القضائيّةِ، والألفاظِ ذاتِ الصّلةِ، ومشروعيتِها والحِكمةِ مِنها، أمّا الفصلُ الثانِي فَقَد عالجَ أقسامُ الإنابةِ القضائيّةِ، ومسوغاتِها، وأركانِها، وشروطِها، وسلطةُ القاضِي في اللجوءِ إليهَا، وتضمن الفصلَ الأخيرَ مواد القانونِ المُتعلّقةِ بالإنابةِ القضائيةِ في التشريعاتِ المعمولِ بها في المحاكمِ الشرعيّةِ وقدَّم بَعَض الصّيغِ للمخاطباتِ التي تَتِمُّ بينَ القُضاةِ لبيانِ الجانبِ العملي.
وخلصت الدراسة إلى مجموعة من النتائج أبرزُها: إِنَّ الإنابَةَ القضائيّةَ تستمدُّ مشروعيتها من الشريعةِ الإسلامِي، كَمَا إنَّ الفقهَ الإسلامي جَعَلَ اللجوءَ إلى الإنابةِ القضائيّةِ حَقٌّ للخصمِ وَعلى القاضِي إجابتّهُ، بينما في القانون فإن الإنابة ترجع إلى سلطة القاضي التقديرية في قبولها أو رفضها، وفي بعض الأحيان تكون وجوبية في حال كان محل النزاع خارج اختصاص المحكمة، كما أن التشريعات المعمول بها في المحاكم الشرعية الأردنية التي تخص الإنابة القضائية جاءت معالجة للموضوع الذي من أجله شرعت الإنابة القضائية، كما توصي الدراسة إلى ضرورة تفعيل نقل الإنابة القضائية طلبًا وردًا عن طريق الوسائل التكنولوجية الحديثة؛ نظرًا لما توفره هذه الوسائل من جهد وتقليل وقت

The study addressed the issue of judicial delegation; Because of the importance of this topic in the course of the trial in the Sharia courts, the study aimed to demonstrate the importance of judicial delegation and its role in achieving rights by making it easier for the disputing parties to prove their arguments before the judiciary. The study relied on the inductive approach and the descriptive approach, in addition to the analytical approach, by tracking the relevant legal materials, attempting to extrapolate all judicial delegations in force in the Sharia courts, and then describing and analyzing them.
This study came in an introduction and three chapters, the first chapter dealt with the nature of judicial delegation, the relevant terminology, its legitimacy, and the wisdom behind it, As for the second chapter, it dealt with the judicial delegation sections, its justifications, its pillars, conditions, and the authority of the judge in resorting to it, The last chapter included the articles of the law related to judicial delegation in the legislation applicable in the Sharia courts and provided some formulas for the communications that take place between judges to demonstrate the practical aspect.
The study concluded with a set of results, the most prominent of which is that judicial delegation derives its legitimacy from Islamic law. Islamic jurisprudence also made resorting to judicial delegation a right for the opponent and the judge must answer him, while in law, delegation is due to the judge?s discretionary authority to accept or reject it, and in some cases, it is obligatory if the subject of the dispute is outside the court?s jurisdiction, Moreover, the legislation in force in the Jordanian Sharia courts regarding judicial delegation came to address the issue for which judicial delegation was initiated, The study also recommends the necessity of activating the transfer of judicial delegation by request and response through modern technological means.
