الملخص بالعربية |
تناولت هذه الأطروحة التي عنوانها الفروق الفقهية عند الإمام الزيلعي من خلال كتابه تبيين الحقائق شرح كنز الدقائق في باب الطهارة، وكان الهدف منه بيان أهمية الفروق الفقهية ، وجمع المسائل المتشابهة في الصورة المختلفة في الحكم مع بيان أوجه الشبه و الإختلاف فيما بينها والعناية بذكر الدليل وتوضيح الخلاف إن وجد فيها بين أئمة المذهب، واعتمدت هذه الدراسة على المنهج المقارن ، وذلك بجمع المسائل والأحكام المتعلقة بموضوع الدراسة وتتبع هذه الأحكام لتشمل قول كل مذهب مع المقارنة بين المذاهب المعروفة.
وتم تقسيم الدراسة إلى مقدمة، وثلاثة فصول، ويليهم الخاتمة والنتائج ،ابتدأ بالفصل الأول :ترجمة موجزة للإمام الزيلعي وكتابه تبيين الحقائق شرح كنز الدقائق ، ثم الفصل الثاني بعنوانه دراسة موجزه للفروق الفقهية ومنهج المذاهب الأربعة والإمام الزيلعي فيها، وآخرها الفصل الثالث: نماذج للفروق الفقهية عند الإمام الزيلعي من باب الطهارة .
وفي نهاية الدراسة أظهرت الباحثة منهج الإمام الزيلعي في توجيه الفرق وطريقة الإستدلال والتعليل وبيان الأثر التطبيقي والعملي للفرق مستأنسا بما ذهب اليه الجمهور في موافقة أو مخالفة ما ذهب إليه الإمام الزيلعي والسادة الحنفية باختصار. لذا فإن الباحثة توصي بإكمال البحث والدراسة في الفروق الفقهية عند الإمام الزيلعي رحمه االله فيما تبقى من أبواب فقهية أخرى، مع غيره من الفقهاء سواء في المذهب الحنفي أوغيره من المذاهب

This thesis dealt with the thesis entitled Differences of Differences among Imam Al-Zaylai through his book Tabyin Al-Haqiqah Sharh Kenz Al-Duqayq in the chapter of Taharah, and the aim was to show the importance of the differences, and to collect issues that are similar in image in different images in the ruling with indicating the similarities and differences between them and taking care to mention the evidence and clarify the difference if any between the two schools of thought and the adoption of this study on the comparative method, by collecting issues and rulings related to the subject of the study and tracking these provisions to include each school of thought comparatively among the known schools of thought.
The study was divided into an introduction, three chapters, followed by the conclusion and results, starting with the first chapter: a brief translation of Imam Al-Zaylai and his book Tibiyan Al-Haqiqah Sharh Kenz Al-Duqaqiq, then the second chapter entitled A brief study of the jurisprudential differences and the methodology and methodology of the four sects and Imam Al-Zaylai in them, and the last chapter is the third chapter Examples of the jurisprudential branches of Imam Al-Zaylai from his door Al-Tara'ah.
At the end of the study, the researcher showed the researcher the methodology of Imam Al-Zaylai's approach in directing the differences and the method of reasoning and modification and indicating the applied and practical impact of the differences, swamped with what the public went in agreement or what Zaylai and the Hanafi masters went to in short, so the researcher by completing the research and study in the doctrinal differences with Imam Al-Zaylai, may God have mercy on him, in the remaining other jurisprudential sections with other jurists, whether in the Hanafi school or other schools of thought
