الملخص بالعربية
هدفت الدراسة إلى توضيح المقصود بقاعدة المشقة تجلب التيسير، وبيان أصل قاعدة "المشقة تجلب التيسير"، وذكر أدلة هذه القاعدة من القرآن الكريم والسنة النبوية المطهرة، والتوصل إلى أهم التطبيقات الفقهية في قاعدة المشقة تجلب التيسير في باب الشركات. وذلك من خلال المنهج الوصفي التحليلي، وقد خلصت الدراسة إلى نتائج عدة كان من أهمها: أن قاعدة (المشقة تجلب التيسير) فإنها قاعدة عظيمة، تواتر النقل عن الأئمة في تعظيم قدرها، وبيان منزلتها في الفقه الإسلامي، وأجمعت عليها كتب القواعد الفقهية وهي من الدعائم والأسس التي يقوم عليها صرح الفقه وأصوله. وأن لقاعدة المشقة تجلب التيسير العديد من التطبيقات المعاصرة منها ما يخص التأمين ومنها ما يتعلق بالأعذار ومنها ما يتعلق بانقضاء الشركات

 The study aimed to clarify what is meant by the rule of hardship brings facilitation, and statement of the origin of the rule "hardship brings facilitation", and mention the evidence of the rule of "hardship brings facilitation", from the Holy Quran and the Sunnah of the Prophet, and access to the most important jurisprudential applications in the rule of hardship brings facilitation in the section of companies. Through the inductive and analytical approach. The study concluded several results, the most important of which were: that the rule (hardship Necessitates Relief) it is a great rule, the frequency of quoting the imams in maximizing its value, and the statement of its status in Islamic jurisprudence, and unanimously written jurisprudence rules, which is one of the pillars and foundations on which the edifice of Islamic jurisprudence and its origins are based. Among the most important recommendations of the study: attention to the study of the rule of "hardship brings facilitation", and the applications that come out of it on the provisions of contemporary companies, and the role of mitigations on people in them, and facilitate what is difficult
