تهدف هذه الدراسة الى بيان حكم "التصرف في الوقف: دراسة فقهية مقارنة" من خلال عرض أقوال وآراء الفقهاء وبيان القول الراجح منها، حيث اتبع الباحث المنهج الاستقرائي والتحليلي لتحقيق أهداف الدراسة، من خلال الإجابة على سؤال الدراسة الرئيسي والمتمثل بـ: بيان حكم التصرف في الوقف في الفقه الإسلامي.
حيث أظهرت نتائج هذه الدراسة إلى: إن حدود التصرف في الوقف تكمن في الالتزام بالشروط والضوابط الشرعية، حيث يجب أن يكون الوقف مشروعاً وأن يتم إدارته بطريقة شرعية تضمن استثمار الأموال وتحقيق أقصى استفادة منها ، وعدم تجاوز الغرض الذي تم تخصيص الوقف من أجله.
كما وأوصت الدراسة بضرورة إنشاء هيئة وطنية متخصصة تكون مسؤولة عن إدارة الأوقاف بشكل مركزي، مما يعزز من كفاءة هذه الإدارة ويساعد على تحقيق أهداف الأوقاف الخيرية والتنموية.

This study aims to shed light on the statement of the ruling Disposal of an Endowment: A Comparative Jurisprudential Study by presenting the sayings and opinions of jurists and stating the most correct opinion of it. The researcher followed the inductive and analytical approach to cover the theoretical aspect and achieve the objectives of this study, by answering the questions of the study; In explaining the dispositions contained in the endowment and the provisions and controls.
The results of this study showed that: The limits of disposal of the endowment lie in adherence to the conditions and Sharia controls, as the endowment must be a legitimate project and be managed in a legitimate manner that ensures the investment of funds and achieving the maximum benefit from them. Do not exceed the purpose for which the endowment was allocated.
The study recommended the necessity of establishing a specialized national body responsible for managing endowments centrally, which enhances the efficiency of this administration and helps achieve the charitable and development goals of endowments
