الملخص بالعربية |
إن منع السفر هو اجراء قانوني يحول بين الشخص ومغادرة وطنه وبلده واعاقة حركتة بحيث لا يستطيع ان يذهب من ذلك المكان الى مكان آخر حفاظاً على حقوق مستحقة عليه للآخرين.
وقد تضمن البحث دواعي اختيار الموضوع، واهمية الدراسة، ومشكلة البحث، وما تم إتباعه من منهج في هذا البحث بالرجوع الى أراء الفقهاء والنصوص القانونية المتعلقة بالموضوع وتم التركيز في هذه الدراسة على حالات منع السفر في المحاكم الشرعية الاردنية، وقد قسمت البحث الى مقدمة، واربعة فصول، وخاتمة، وقد تبين أن الحكم في منع السفر يأتي في عدة مجالات وذلك كإجراء احتياطي تحفظي لصيانة الحقوق لأصحابها سواء كان ذلك في الأمور التجارية أو في حالات الافلاس حيث ان منع المدين من السفر هو التضيق عليه ومنعه من ممارسة حقه في التنقل حفاظا لاصحاب الحقوق من ضياع حقوقهم، وكذلك الحكم بمنع السفر جائز في الاحوال الشخصية خاصة في الحالات التالية : -
السفر لصالح الزوجة في بعض الأحوال منها النفقة وما تشملها. والمهر المعجل والمهر المؤجل في حالة الطلاق البائن بينونة صغرى او بينونة كبرى وكذلك منع الزوج (الاب) من السفر باولاده المحضونين خشية حرمان والدتهم من المشاهدة والحضانة ومنع الام من السفر بصحبة اولادها المحضونين. في حالة حضانتها للأطفال حتى يتسنى للأب مشاهدتهم وللجد لاب كذلك وللإشراف على تربيتهم.
