الملخص بالعربية |
تناولت هذه الدراسة موضوعاً مميزاً يتعلق بأحكام الطيور في الفقه الإسلامي وبيان آراء الفقهاء فيها ،هذه الأحكام ضرورية الوجود في مجتمعنا حيث لا يمكن الإنفكاك عنها ،مما استدعى أن يتم تناولها والحديث عنها بشكل مقارن ،لأن استخدامها إذا لم يخضع لضوابط الشرع وأحكامه ويساس بسياسته وموازينه ،قد يعم معه الضرر ،ويستشري منه الخطر ،ما دام الحال هكذا فلا غرابه أن تكون أحكام الطيور موضوع للبحث والاستقصاء ،لأن الشريعة مهما طال الزمن وتطورت الحياة واستجد من النوازل فلن تعدم حكما شرعيا ،يتم إنزاله على تلك النوازل او المستجدات ،ولو تعدت الأوصاف وتباعدت العلل .
وتكونت هذه الدراسة من مقدمة ، ثلاثة فصول ، وخاتمة ،تم الحديث فيهم عن التعريف بالطيور والأحكام وتحديد المقصود فيها ثم الحديث عن استخدام الطيور في البحث العلمي من جهة التشريح ، والتحنيط ،واحكام مخلفات الطيور في مستحضرات تجميل ،واحكام تسميد التربه بذرق الطيور،وبيان اقوال الفقهاء وادلتهم ومناقشتهم وبيان الترجيح كما يرى الباحث ومن ثم بيان احكام الطيور مأكولة اللحم وغير مأكوله ،ثم انتقلت الى احكام ذبح وصيد الطيور وحبسها وبيعها مع تفصيل كل مسألة على حدا .
وتوصل الباحث عبر هذه الرساله الى مجموعة من النتائج والتوصيات من ابرزها أستخدام الطيورمن حيث الحكم الشرعي يمكن أن يعتريه الأحكام الشرعية التكليفية الخمسة ،ومن القواعد الفقهيه والضوابط الشرعية التي تضبط استخدام والتعامل مع الطيور ،قاعدة الأمور بمقاصدها ،وقاعدة لا ضرر ولا ضرار ،وقاعدة درء المسده اولى من جلب المصلحه ،وقاعدة الضرر الاكبر يزال بالضرر الاصغر ،ومن الضوابط الشرعية التي تضبط استخدام التعامل مع الطيور حفظ الدين ،وحفظ النسل ،وحفظ العرض وعدم معارضتها للشريعة الإسلامية والإلتزام بالأخلاق الفاضلة أثناء استخدام هذه الطيور

This study dealt with a special issue concerning the provisions of birds in Islamic jurisprudence and the opinions of jurists. These provisions are necessary to exist in our society where they can not be avoided.
