فتتناول هذه الدراسة أثر الاستحسان في تصحيح العقود المالية، حيث مهدت للموضوع من خلال بيان تعريفات الاستحسان وبيان ضوابطه وانواعه وحجية الاستحسان عند العلماء.
كما درست مفهوم التصحيح ومفهوم العقود المالية. وبيان اقسام العقود من حيث الصحة والبطلان ومشروعية التصحيح وشروطه. وبيان قواعد التصحيح المتعلقة بالاستحسان.
كما اهتمت هذه الدراسة في بيان أثر الاستحسان من خلال توضيح، تطبيقات تصحيح العقود الاستثنائية الأصيلة والمعاصرة لبيان مدى اعتمادهم على الاستحسان كمصدر من مصادر التشريع، بالإضافة الى تصحيح العقود كنوع من أنواع الرخص، فتم تصحيح العقود التي يحتاجها الناس ، وان لم تجر على القواعد العامة، ولكن اجازها الشارع استثناء من القواعد العامة في البيوع، وقد قمت ببيان وجه الاستحسان للعقود، كما بينت ان الاستحسان له أثر كبير ومهم في تصحيح العقود المالية، لرفع الحرج والمشقة عن الناس وللضرورة وان هناك عقود فيها جهالة يسيرة معفي عنها، فصحح العقد استحسانا

This study discusses the effect of Istihsan in correcting financial contracts, as it paved the subject through explaining the definitions of Istihsan, its controls, types, and the authoritative approval of scholars. It also studied the concept of correction, the concept of financial contracts, and a statement of the contract sections regarding health, invalidity, the legality of the correction and its conditions. The study clarified the rules of correction related to the approval of the Istihsan.
This study was also interested in explaining the effect of Istihsan by clarifying the applications of correcting old and contemporary exceptional contracts to indicate the extent of their dependence on Istihsan as a source of legislation, in addition to correcting contracts as a type of license, so contracts that people need were corrected, even if they were not conducted on general rules But it was approved by the street as an exception to the general rules on selling.
I have indicated in this study the aspects of Istihsan on financial contracts, I also have indicated that the approval has a significant and important impact in correcting financial contracts, to remove the embarrassment and hardship on the part of the people and for necessity. There are contracts that includes allowed simple ignorance that?s exempted by Istihsan
