الملخص بالعربية |
تناولت هذه الدراسة النظام القانوني لوسطاء التأمين في التشريع الأردني دراسة مقارنة، وهدفت إلى بيان الأسس القانونية الناظمة في تشريعات دول المقارن والأردن، التي تهدف لضبط قانون عمل وسطاء التأمين، وبيان مدى شمولية القوانين في الأردن ودول المقارن بوضع أسس قانونية تضمن حقوق وسطاء التأمين، والتعرف على الفروق ذات الأثر المباشر في عمل وسطاء التأمين في التشريع الأردني والتشريعات العربية، حيث بينت الدراسة طبيعة عمل وسطاء التامين وآليات عملهم، وكذلك الأحكام القانونية لعقد وسطاء التامين.
وتم من خلال هذه الدراسة، الذي استخدام المنهج الوصفي التحليلي القانوني والمنهج المقارن، ولقد اظهرت الدراسة عدة نتائج منها: اولى التشريع الأردني والتشريعات العربية المقارنة أهمية عالية لعمل وسطاء التامين وتبين ذلك من خلال تنظيم اعمالهم بواسط تشريعات قانونية خاصه، الزم المشرع في كافة التشريعات وسيط التأمين بالإعلام والنصيحة والتحقق بحيث يلتزم وسيط التأمين بالتحقق من هوية طالب التأمين والتأكد من البيانات والمعلومات المصرح بها عند التعاقد وأثناء سريان العقد.
واوصت الدراسة الجهات الحكومية من خلال الأعلام الرسمي العمل على توعية طالب خدمة التأمين من أخطار العمل مع سماسرة التأمين، من خلال الإعلانات والنشرات في كل مواقع التأمين. |

This study dealt with the legal system for insurance brokers in Jordanian legislation in a comparative study, and aimed to clarify the legal foundations regulating the legislation of the comparative countries and Jordan, which aims to regulate the work law of insurance brokers, and to demonstrate the comprehensiveness of the laws in Jordan and the comparative countries by establishing legal foundations that guarantee the rights of insurance brokers, and identifying On the differences that have a direct impact on the work of insurance brokers in Jordanian and Arab legislation, as the study showed the nature of the work of insurance brokers and their work mechanisms, as well as the legal provisions for the insurance brokers? contract.
Through this study, which used the descriptive, analytical, legal approach and the comparative approach, the study showed several results, including Jordanian legislation and comparative Arab legislation gave high importance to the work of insurance brokers, and this was demonstrated by regulating their work through special legal legislation. The legislator obligated in all legislation an intermediary. Insurance through information, advice, and verification, so that the insurance broker is obligated to verify the identity of the insurance applicant and verify the data and information declared upon contracting and during the validity of the contract.
The study recommended that government agencies, through official media, work to educate insurance service applicants about the risks of working with insurance brokers, through advertisements and bulletins on all insurance websites
