الملخص بالعربية |
عُنيت هذه الدراسة بمسائل السياسة الشرعية التي وجدت عند الإمام ابن حزم الظاهري في كتابه "المحلى"، على الرغم أن ابن حزم قد أٌختلف فيه على أنه قد أخذ بالسياسة الشرعية أم لا ورأيه بالقياس والإستحسان وقد وجد أنه قد أخذ فيهم وعبرعنهم بمعاني ومفردات أخرى سنأتي على ذكرها إن شاء الله تعالى .
تناولت هذه الدراسة التعريف بابن حزم وكتابه المحلى ومفهوم السياسة الشرعية وبيان الإمامة ( معناها وحكمها وشروطها وأحكامها )، وكذلك الحديث عن الشؤون المالية والشؤون القضائية والشؤون الدولية والجنائية وتطبيقاتها الشرعية .
تبين للباحث بعد إستقراء السياسة الشرعية عند الامام ابن حزم أنه ومع عدم أخذه بالقياس والإستحسان إلا أنه يعبر عنهم بمعاني ومفردات معينة، وأنه قد جمع بين مفهوم السياسة الشرعية والإمامة والخلافة وأنه لم يخالف فقهاء المذاهب الأربعة في أن أصل السياسة ما وافق شرع الله من قرآن وسنة، وقد سلك ابن حزم المسلك التاريخي لتأكيد ما ذهب إليه من أفكار حول السياسة الشرعية والخلافة.

This study dealt with the definition of Ibn Hazm and his local book the concept of Sharia policy and the statement of the Imamate (its meaning, ruling, conditions and provisions) as well as talking about financial affairs, judicial affairs, international and criminal affairs and their legitimate applications It became clear to the researcher, after extrapolating the legal policy of Imam Ibn Hazm, that although he did not take it by analogy and approbation, he expresses them with certain meanings and vocabulary, and that he has combined the concept of legal politics, imamate and caliphate, and that he did not contradict the jurists of the four schools in that the origin of politics is what agreed with God?s law of the Qur?an and Sunnah,Ibn Hazm took the historical path to confirm his ideas about legitimate politics and the caliphate
