الملخص بالعربية |
يعد موضوع العرف من الموضوعات الماسة والمهمة في حياتنا العامة, التي يؤخذ منها الأحكام الفقهية , وأشرت في الدراسة الى أهمية العرف بالنسبة إلى قانون الأحوال الشخصية الأردني لسنة 2019 , وأثر العرف في إصدار الأحكام والقوانين التي لم يرد بها نصاً شرعياً, ومع بيان أيضاً اعتماد دائرة الإفتاء العام الأردنية في اصدار الفتوى واعتمادها على عرف الناس , وقد اشتملت هذه الدراسة على بيان العرف وأهميته وأقسامه وأنواعه , كما تناولت مسائل عرفية تطبيقية على قانون الأحوال الشخصية الأردني, ومسائل تطبيقية على الفتوى التي تصدر من قبل دائرة الإفتاء العام .
واعتمدت الدراسة على المنهج الاستقرائي: وذلك من خلال معرفة حقيقة العرف ووظائفه وضوابطه, وكذلك المنهج الاستنباطي (الاستدلالي): وذلك من خلال تتبع كليات الموضوع باستعراض أدلته وأحكامه من القرآن الكرم والسنة النبوية وإجماع العلماء وآرائهم، وتعليل وبيان ما تم استقراؤه حول موضوع العرف.
ومن أهم النتائج التي توصلت اليها الدراسة، إبراز حقيقة العرف في قانون الأحوال الشخصية وفي دائرة الإفتاء العام واعتماد الفتوى عليه ، ويكثر استخدام العرف في المسائل الاجتهادية والمعاملات المالية، مع استند قانون الاحوال الشخصية الاردني على كثير من المسائل العرفية ولا سيما في باب النكاح .

The issue of custom is one of the urgent and important topics in our public life, from which jurisprudence rulings are taken, and I indicated in the study the importance of custom in relation to the Jordanian Personal Status Law of 2019, And the impact of custom on issuing rulings and laws that were not mentioned in a legal text, and with a statement also that the Jordanian General Ifta? Department relied on issuing fatwas and its reliance on people?s custom, This study included a statement of custom, its importance, its divisions, and types. It also dealt with applied customary issues on the Jordanian Personal Status Law, and applied issues on the fatwa issued by the General Iftaa Department.

The study relied on the inductive approach: by knowing the reality of custom and its functions and controls, as well as the deductive approach: by following the faculties of the subject by reviewing its evidence and rulings from the Holy Qur?an, the Prophet?s Sunnah, the consensus of scholars and their opinions, and the explanation and statement of what has been extrapolated on the subject of custom.
Among the most important findings of the study, highlighting the reality of custom in the Personal Status Law and in the General Iftaa Department and the adoption of the fatwa on it, and the frequent use of custom in matters of discretion and financial transactions, with the Jordanian Personal Status Law based on many customary issues, especially in the matter of marriage
