يعد موضوع التعسف في استعمال حق الولاية من الموضوعات التي تؤثر سلبا على المجتمع، فالتعسف ناتج عن انحراف الولي عن مساره الذي حدده الشرع والقانون فيصير أداة للظلم والجور والقسوة، بدل أن يكون أداة للعدالة، وفي هذا البحث نجد أن قانون الأحوال الشخصية ضبط عملية الولاية بحدود موصوفة تبين انتهاء حق الولاية عند التعسف فيها، ومن أهم أهداف هذا البحث بيان مفهوم التعسف في استعمال حق الولاية، ودور قانون الأحوال الشخصية في الحفاظ على حقوق المولى عليهم، وقد اشتملت هذه الدراسة على ثلاثة فصول، تناول الفصل الأول مفهوم التعسف والولاية، وكما تناول الفصل الثاني التعسف في الولاية في الزواج في قانون الأحوال الشخصية الأردني، وتناول الفصل الثالث على الولاية على القاصر في القانون، وأهم ما النتائج التي توصلت لها الدراسة: لا يحق لأحد إجبار المرأة على الزواج، الأب هو الولي الأقرب على مال القاصر ويحق له استثماره ورهنه بما فيه مصلحة للقاصر |

The issue of abuse in the use of the right of guardianship is one of the topics that negatively affect society. The abuse is caused by the deviation of the guardian from his path defined by Sharia and the law, and becomes a tool for injustice, injustice and cruelty, instead of being a tool for justice. In this research, we find that the personal status law controls the guardianship process within the limits Described showing the end of the right of guardianship when abused, and one of the most important objectives of this research is to clarify the concept of abuse in the use of the right of guardianship, and the role of personal status law in preserving the rights of the guardian over them. The second chapter deals with the abuse of guardianship in marriage in the Jordanian Personal Status Law, and the third chapter deals with the guardianship of minors in the law, and the most important findings of the study: No one has the right to force a woman to marry, the father is the closest guardian to the minor?s money and he has the right to invest and mortgage it In the interest of the minor |
