الملخص بالعربية |
تتناول هذه الدراسة الشرح والتحليل للقاعدة الفقهية (إذا ضاق الأمر اتسع)، وهي قاعدة مهمة في رفع المشقة والحرج الواقع على المكلفين، فهي قاعدة مندرجة ضمن المفهوم العام لقاعدة (المشقة تجلب التيسير)، وهذه القاعدة قد أجمع العلماء على إعمالها وتقريرها.
وجاءت هذه الدراسة في مقدمة ثلاثة فصول، بينت في المقدمة مشكلة الدراسة وأهدافها، خطيتها، ومنهجيتها، والدراسات السابقة المتعلقة بموضوع الدراسة.
ثم في الفصل الأول بينت الإطار النظري للقاعدة، من حيث توضيح مفهومها، والأدلة الشرعية التي تدل على تقرير هذه القاعدة، وعلاقة هذه القاعدة بغيرها من القواعد الفقهية.
ثم في الفصل الثاني بينت التطبيقات لهذه القاعدة في أبواب الطهارة والصلاة، حيث اتضح من خلالها تطبيق القاعدة على مسائل في الطهارة منها استعمال الكحول، وحكم الغسيل بالبخار، وكذلك في الصلاة حيث ظهر تطبيق هذه القاعدة في التخلف عن الجماعات بسبب الأوبئة، والتباعد بين المصلين في الصفوف في الصلاة في حالات الأوبئة، وفي الجنائز، من خلال حكم تشريح الميت، والحاجة في بعض الصور إلى دفن أكثر من شخص في قبر واحد بسبب تزايد أعداد الموتى.
ثم في الفصل الثالث بينت التطبيقات في أبواب الصوم والزكاة والحج، من خلال حكم نقل الزكاة، وحكم الصوم للمريض، وحكم التخلية في طريق الحج واشتراطها.
وأخيراً ذكرت خاتمة بينت فيها أهم نتائج البحث والتوصيات.

This study deals with the explanation and analysis of the jurisprudential rule (whenever the circle of a matter narrows, it is widened by easements), which is an important rule in dealing with hardship and burdens that befall the Mukallaf, a person who is responsible for his duties by Allah. As it is a rule included in the general concept of the rule (hardship brings easements), and this rule has been unanimously by scholars to implement and endorsement.
This study includes an introduction and three chapters, which showed in the introduction the problem of the study and its objectives, its methodology, and previous studies related to the subject of the study.
Then, in the first chapter, I explained the theoretical framework of the rule, in terms of clarifying its concept, and the Sharia evidence that indicates this rule, and the relationship of this rule with other rules of jurisprudence.
Then, in the second chapter, it showed the applications of this rule in the chapters of ritual purity and prayer, as it became clear through them the application of the rule to matters of ritual purity, including the use of alcohol, washing with steam. And also in prayer, where the application of this rule appeared in missing the congregational prayer due to epidemics, and the distancing between worshipers in rows in prayer in cases of epidemics. The rule has been shown also in funerals, on dissecting the dead, and the need in some cases to bury more than one person in one grave due to the increasing number of deads.
Then, in the third chapter, the applications are shown in the chapters of fasting, zakat and Hajj, through the ahkam of transferring the Zakat, fasting for the sick, and removing the obstacles from the way of Hajj and its requirement.
Finally, in the conclusion, I explained the most important results of the research.
