الملخص بالعربية |
تناولت هذه الدراسة الموسومة بـ " أسباب الطلاق والتعامل معها وقايةً وعلاجاً من واقع عمل مكاتب الإصلاح الأسري " الحديث عن هذه الأسباب التي وقف عليها الباحث بحكم عمله في مكتب الإصلاح الأسري ، وذلك في فصلين :
تناول في الفصل الأول التعريف بمديرية الإصلاح والوساطة والتوفيق الأسري وآثار مكاتبها في الحد من المشكلات الزوجية ، كما جاء الكلام فيه عن التأصيل الفقهي في الاجتهاد المعاصر لإنشاء هذه المديرية القائم ضمن علمَي أصول الفقه ومقاصد الشريعة ، وأن المصلحة المرسلة هي المستند في الاجتهاد المعاصر لإنشائها ، وأن فكرة إنشائها نازلة على مقتضى قواعد الشريعة ، و راجعة إلى حفظ أصل الملة ، وحياطة أهلها في تصرفاتهم العادية ، وما هذا الاجتهاد المعاصر في إنشائها ما هو في حقيقته إلا إعمال وتطبيق للسياسة الشرعية العادلة الموافقة للشريعة .
كما عرض الباحث للإحصائيات الصادرة عن دائرة قاضي القضاة في مسائل الطلاق والتفريق بين الزوجين من الأعوام (1992 ? 2019) م ، وبيان أهمية هذا العرض وأثره في لفت نظر القائمين على شأن الأسرة إلى وجوب التنبُّه لنتائجها وتقديم الحلول للحد منها.
وجاء مقام الكلام في الفصل الثاني عن أسباب الطلاق من واقع عمل مكاتب الإصلاح الأسري ، وتبين له أنها مقسمة إلى أسباب دينية و أسباب اجتماعية وثقافية ، وأسباب اقتصادية ، وأسباب صحية ونفسية .
كما جاء هذا المقام من الكلام بذكر دور مكاتب الإصلاح في التعامل مع أسباب الطلاق وقاية ، وعن جهود وانجازات المديرية في الوقاية والعلاج. |

The present study, titled "the causes of divorce based on the reality of the work of the family reform offices and their preventive and treating role in dealing with these causes - an analytical jurisprudence study" aims to investigate these causes that the researcher could reach based on his work in the family reform office, in two chapters: the first chapter deals with the definition of the Directorate of Reform, Mediation and Family Reconciliation and the effects of its offices in reducing marital problems, besides debating the jurisprudential base in contemporary jurisprudence to establish this directorate that is settled based on the two sciences of the fundamentals of jurisprudence and the objectives of Sharia, where the researcher pointed out that this ijtihad which was within the science of Usul Al-Fiqh had been in two directions: the first: the realization of the circumstances, and the second: the legal evidence upon which this ijtihad is based, and as for the objectives of Sharia, it was by showing the interconnectedness and harmony between what was explained in the two previous directions and the jurisprudence of the wise legislation which aims at taking care and protecting the necessary purpose of preserving the offspring. The researcher has shown that the public interest is the base in contemporary ijtihad to establish the directorate, and that the idea of its establishment is based on the requirements and rules of Shari?a, and is due to preserving the origin of the sect and protecting its people in their normal behavior, where the contemporary Ijtihad in establishing the directorate is in fact an application for the fair legislative policy which comply with Al-Shar?a. The researcher also presented the statistics issued by the Supreme Judge Department about the cases of divorce and the separation between spouses for the years (1992 - 2019). He pointed out the importance of this presentation and its impact to draw the attention of those in charge of the family affairs to the necessity of paying attention to its results and providing solutions to reduce these cases. The second chapter was about the reasons for divorce which were elicited from the reality of the work of the family reform offices, where they were found to be religious, social, cultural, economic, health and psychological reasons. Besides, the chapter discussed the preventive role of the reform offices in dealing with the causes of divorce, and the efforts and the achievements of the Directorate in prevention and treatment |
