Abstract
This study, which represents a practical aspect of the purposes of Islamic law, was based on all research opinions issued by the Jordanian Fatwa Department until 1-11-2018, about fifty-one thousand, and in this study I have developed fatwas related to the purposes of the sharia with regard to the necessary, coronal and analytical interests, and then studied these fatwas with regard to the purposes of the evidence.
I mentioned in this study: The opinions of the doctrine of some, not all, fatwas that violate the legal judgment adopted in the fatwa, and this, if the disagreement is apparent, in order to avoid the prolongation, and so that the focus of this study is not on doctrinal differences; because the purpose of this study is to elicit and study legitimate purposes
This study is different from the rest of the studies related to the science of the purposes of Islamic law, as this topic came to show a practical aspect of the science of Islamic law in the research opinions issued by the Jordanian Fatwa Department, and the previous studies were theoretical, not applied.
This study aims at showing the spirit of Islamic law, and to show that all legitimate provisions were not in vain; they all came to achieve the interest or prevent the corrupting, and this is what is meant by the purposes of Sharia, and this study was also used to establish confidence among people in the Jordanian Fatwa, considering it a reliable religious authority, indicating flexibility in the statement of Sharia judgments and their observance of legitimate purposes, without the fanaticism of one religion, which is adopted by Muslims, and where it is based on religious opinions.
I divided this thesis into Introduction, introductory chapter, three chapters and conclusion.
I mentioned in the introduction: The importance of the study, its problem, its objectives, previous studies and the approach followed in this study
The introductory chapter, in the statement of the concept of the fatwa, the purposes and their rise, and its sections: Necessities (preservation of religion, soul, mind, birth and money), the statement of what is meant by needs, improvements and illustrative examples of these purposes.
The first chapter was the search for the five necessities and their divisions, the development of these necessities from the fatwas of the Jordanian Fatwa Service, the study of them, the connection with the fatwa, and the mention of evidence
The second chapter was the search for the needs, the development of this purpose of the fatwas issued by the Jordanian Fatwa Service, the connection of these fatwas to the Hajji destination, and the evidence was mentioned.
The third chapter of this thesis came to examine the subject of the proverb of the Tahirayat, draw it from the fatwa, link it to the advisory opinion, mention the evidence on it, and refer to the opinions of the scholars regarding all these purposes.
The conclusion included the most important findings and recommendations of this study, and the last of our invitations is to thank God the Lord of the Worlds.
