الملخص بالعربية |
قُمت في هذا البحث بجمع المعلومات من الكتب الفقهية والقانونية عن حقيقة الدعاوى من حيث مفهومها وشروطها، ثُمَ قمت بتعريف الإثبات والطلاق في اللغة والقانون والفقه.
ثُمّ قمت بذكر حقيقة الدفوع من حيث المفهوم والمشروعية والأنواع والشروط والآثار وأوجه الإتفاق والإختلاف فيها بين القانون والفقه.
وفي النهاية قمت بذكر أنواع الدفوع الموضوعية الواردة في دعاوى إثبات الطلاق بشكل خاص مع نقل آراء الفقهاء في كل دفع ورأي القانون في الدفوع مع بيان الجانب التطبيقي على الدفوع المذكورة.
وقد استخدمت المنهج الإستقرائي في هذه الدراسة.

In this research, I collected information from jurisprudentiall and legal books on the truth of the clims in terms of their concept and conditions, and then defined the proof and divorce in language, law and jurisprudence.
I then mentioned the means of proving the divorce clim and its applications in the shariah courts and the opinion of the jursts on the authoritative extent of each of the means mentioned in the proof, with the opinion of the law in it.
Then I mentioned the truth of the defences in terms of their leqitimacy, divisions,types, conditions, effects and agreements between law and jurisprudence.
Finally, Mentioned in the divorce cases in particular together with showing the legal opinions in each case, and the word of law in defences mentioning the side of application for the Mentioned defences
