الملخص بالعربية |
تناولت هذه الدراسـة التعرف على حُجِّية التَّسجيلات المرئيَّة والمسمُوعة في الإِثبات الجـنائي " دراسة موازنة بين القانونين الاردني والمصري " ، وحيث تكمن مشكلة الدراسة في مدى مشروعية الأخذ بالتَّسجيلات المرئيَّة والمسمُوعة وحجيتها في الإِثبات الجـنائي، ومدى تأثير الأدلة المتحصلة عن التسجيلات المرئية والمسموعة على قناعة القاضي الوجدانية والاعتماد عليها كوسيلة من وسائل الإِثبات الجـنائي في القانونين الاردني والمصري . واعتمد الباحث على المنهج الوصفي والتحليلي والموازن القائم على وصف واقع المشكلات والظواهر من خلال بيان معالم وعناصر النصوص القانونية التي تناولت موضوع التسجيلات المرئية والمسموعة وبتحليل النصوص القانونية ذات العلاقة بموضوع الدراسـة والأسس القانونية التي تقوم عليها وذلك بشكل علمي وموضوعي بالاستعانة بمنهج التحليل للوقوف على اوجه القصور واستخدام أسلوب الموازنة بين القوانين الاردني والمصري وصولاً لأفضل التجارب، وذلك لمعالجة الموضوع بشكل سليم وقانوني , وحيث توصلت الدراسـة إلى مجموعة من النتائج اهمها: غياب التنظيم التشريعي وخصوصاً في قانون أصول المحاكمات الجزائية لمعالجة الأدلة المتحصلة عن التسجيلات المرئية والمسموعة، وأوصت الدراسـة بضرورة قيام المـشرع الأردني بتعديل تشريعي في قانون أصول المحاكمات الجزائية بما يواكب ويستجد من تطورات في مجال تكنولوجيا المعلومات والجرائم المستحدثة. |

The current study has focused on identifying the Res Judicats of Videos and Recordings in Criminal Evidence ?A Parallel Study between the Jordanian and Egyptian Law? the problem of the study lies within the degree of theauthenticity of audio and visual recordings to be criminal evidence. Another problem is the extent of the impact ofthe evidence obtained from the audio and visual recordings on the judge?s emotional conviction and reliance on it as a means of criminal proof in the Jordanian and Egyptian laws.The researcher followedthe descriptive-analytical approach, whichdescribes the sources of problems by clarifying the features and elements of legal texts that dealt with the subject of the audio and visual recordings. It also analyses the legal texts that are related to the topic of the study and the legal foundations that are based on it; this is done scientifically and objectively based on the analytical approach to identify the shortcomings using the parallel method between Jordanian and Egyptian laws to get the best experimentalresults properly and legally. There were several findings for this study, but the most significant one was the absence of the legislative regulation particularly in the Criminal Procedures Law to deal with the evidence that is obtained from audio and visual recordings. Finally, the study recommended that it is essential for the Jordanian legislator to make regular amendments on the Criminal Procedures Law to keep pace with the latest developments of information technology and emerging crimes |
