هدفت هذه الدراسة إلى بيان معنى الحكم الشرعي وأقسامه, وبيان معنى المصلحة الشرعية وأقسامها, وضوابطها الشرعية, وبيان مراعاة الإسلام لمصالح الناس, وحرص الشريعة الإسلامية على بناء مجتمع إسلامي قائم على المبادئ الإسلامية، مراعية لأحوال الناس ومصالحهم بالدرجة الأولى, ومع تغير الأزمنة تتغير المصالح وتتجدد؛ لتتوافق مع المستجدات في العصر الحاضر, وإذا تغيرت المصلحة هل يتغير الحكم الشرعي أم لا؟
اتفق العلماء على أن الأحكام الشرعية إنما جاءت لتحقيق مقاصد الشرع من جهة وتحقيق مصالح العباد من جهة أخرى, وإنما اختلفوا في حكم تعطيل تطبيق حكم من الأحكام الذي هو مصلحة ظاهرة بدليل الشرع , وذلك لأجل مصلحة أخرى طارئة بدليل الشرع إما خاصة أو عامة, ويكون اعتماد المجتهد على العام أكثر.

This study aimed to clarify the meaning of the legal ruling and its divisions, and to clarify the meaning of the legitimate interest and its divisions, and its legal controls, and to clarify the observance of Islam for the interests of people, and the keenness of Islamic Sharia to build an Islamic society based on Islamic principles, taking into account the conditions of people and their interests in the first place, and with the change of times, interests change and are renewed ; To comply with the developments in the present era, and if the interest changes, does the legal ruling change or not?
