الملخص بالعربية |
جاءت هذه الرسالة إلى بيان مدى أثر الفقه الإسلامي في الدستور الأردني، وبيان مدى تأثر مشرع الدستور الأردني بالفقه الإسلامي، من خلال دراسة مواد الدستور ومقارنتها بالفقه، وانتهج الباحث المنهج الوصفي التأصيلي للوصول إلى مدى تأثر الدستور الأردني في الفقه الإسلامي ، والمنهج الاستنباطي وذلك بربط المقدمات بنتائجها والوصول بالكليات إلى الجزئيات، والمنهج المقارن وذلك من خلال المقارنة ما بين الدستور الأردني والفقه الإسلامي.
وقد توصلت الدراسة إلى أن هنالك أثراً للفقه الإسلامي على الدستور الأردني من خلال تأثر المشرع بالفقه عند وضع النصوص القانونية للدستور الأردني، وظهر ذلك في ما يتعلق بتأسيس الدولة ونظام الحكم، وما يتعلق بالحقوق والواجبات للمواطن الأردني، وما يتعلق بالسلطات الثلاث واختصاصاتها، حيث أن الشريعة تنقسم إلى عقيدة وعبادات ومعاملات وأخلاق، وتبين أن الدستور اعتنى بهذه الجوانب من خلال النصوص الدستورية، والتي تبنت الجانب العقدي باعتماد الدين الإسلامي الدين الرسمي للدولة، وأما جانب العبادات فيظهر من خلال المؤسسات الدينية الشرعية بالدستور التي تعنى بهذا الجانب.

This study aimed to demonstrate the extent of the impact of Islamic jurisprudence on the Jordanian Constitution, and to examine the influence of the Jordanian legislator on Islamic jurisprudence .This is done by studying the articles of the Jordanian Constitution and comparing them with jurisprudence.
The researcher followed the inductive approach by extrapolating legal texts to reach at general principals and roles that show the extent of the impact of Islamic jurisprudence on the Jordanian Constitution In addition, the researcher followed the deductive approach by linking the introductions to their results and accessing faculties to the particales and the comparative approach.
The other goal is to compare between Jordanian Constitution and Islamic jurisprudenceThe study conclude that there is an effect of Islamic jurisprudence in the Jordanian Constitution, which is evident through the legislator with jurisprudence when developing the legal text of the Jordanian constitution.
This was an evident with regard to the establishment of the state and the system of judgment, what is related to the right and duties of the Jordanian citizens, as well as, what concern the three authorities and competencies.
Since the Islamic laws was devided ; into belief; worship; transactions and ethics, it became clear that: the Constitution took care of these aspects through the constitutional article's , which has adopted the doctrinal aspect by adopting the Islamic religion of the state or the aspect of the ritual acts that appears through the legitimate religious institution that are concerned with these aspects
