الملخص بالعربية
تسعى هذه الدّراسة إلى تحديد وتحليل قاعدة "الضّرر يُزال " وتطبيقاتها الفِقْهيّة على إزالة الضّرر الذي يجري بين الزوجين في قانون الأحوال الشخصيّة الأردنيّ، وجاءت هذه الرّسالة في ثلاثة مباحث، تحدّث المبحث الأّول منها عن تعريف قاعدة الضّرر يُزال، ثم بيان حكمها وشرحها وتوضيح الضّوابط لهذه القاعدة، ثم تطرَّق المبحث الثْاني إلى بيان الأضرار التي تلحق بالزّوجة ومعرفة الرأّي الفِقْهيّ وعلاقته في قانون الأحوال الشّخصيّة وإزالة الضّرر بناءً على قاعدة الضّرر يُزال، ومثّل على ذلك من قانون الأحوال الشخصيّة كإزالة ضْرر العُدول عن الخِطبة، أو عدم الإنفاق أو الغَيْبَة أو الفقد أو غير ذلك، ثم تطرَّق المبحث الثَّالث إلى بيان الضّرر الذي يلحق بالزّوج والرّأي الفِقْهيّ والقانونيّ بناءً على قاعدة الضّرر يُزال، مثّل على ذلك من قانون الأحوال الشّخصيّة كنشوز الزوجة أو عدم الوفاء بالشّرط أو ضرر المرأة المحبوسة.

 This study seeks to identify and analyze the rule of the damage is removed and its doctrinal applications to remove the damage to both spouses from the Jordanian civil status act. This study consisted from three sections the first one talked about the definition of the damage rule is removed and thin statement of its judgment , explanation and clarification of the rules of this rule . The second section talked about the statement of the damages that done to wife and the knowledge of the dentinal opinion is the respect and link the civil status act in this how remove the damage that is based on the damage is removed and on that from the civil studies act applied the rule of removing the damage of refusing the mirage, lack of spending alibi or disappearing of husbands . The third section talked about the statement of the damage to the husband and statement of juristic and legal opinion in that case that based on the rule of the damage is removed and on that from the civil states act applied the dissilience wife or non-fulfilment of the gradation or the damage that relate to the locked us women
