الملخص بالعربية
تناولت الدراسة الضبط الإداري الصحي وأثره على حق التعليم في ظل تطبيق قانون الدفاع الأردني، بحيث يترتب على العمل بقانون الدفاع آثار قانونية مختلفة، ومنها على حق التعليم، وتناولت ماهية الضبط الإداري الصحي وأثره على حق التعليم في الظروف الاستثنائية، وتحقيقًا لأهداف الدراسة استخدم المنهج الوصفي التحليلي ومنهج الشرح على المتون. وخلصت الدراسة إلى نتيجة مفادها أن الدستور الأردني لسنة 1952 وتعديلاته أكد على الحق في التعليم من خلال المواد (6 و 19 و 20) منه، حيث أخذ ببعض المعايير الدولية، وخاصة فيما يتعلق بمبدأ المساواة وعدم التمييز في مجال التعليم، كما أخذ بمبدأ تكافؤ الفرص في التعليم، وإلزامية التعليم الابتدائي ومجانيته، وجاءت المادة (10) من قانون وزارة التربية والتعليم، منسجمة بما جاء في أحكام المادة (20) من الدستور الأردني والتي جاء فيها أن التعليم الابتدائي إلزامي للأردنيين ومجاني في المدارس الحكومية، إلاّ أنه وبالعودة للنصوص التشريعية التي تحكم الظروف الاستثنائية فإنه لا يوجد ما يضمن عدم تغول السلطة التنفيذية على حق التعليم إزاء الظروف الاستثنائية. وقدمت الدراسة توصيات أبرزها، ان يكون للبرلمان رقابة على قرار اعلان العمل بقانون الدفاع والغاء العمل به في حال زالت مبررات استمرار العمل به، ليمارس رقابته على شروط إعلان حالة الطوارئ المنصوص عليها في الدستور، وضرورة تضمين هذه الرقابة بنصوص دستورية، حتى يتسنى للبرلمان مراقبة أعمال الحكومة أثناء العمل بقانون الدفاع من أجل مساءلتها وحجب الثقة عنها إذا تجاوزت صلاحياتها، أو تعسفت في استعمال حقها، أو أنها لم توقف العمل بقانون الدفاع في حال زالت مبررات إعلان العمل به، واستمرارها العمل به دون مبرر.

The present study aimed to shed a light on the healthcare- administrative control and its impact on education right in light of enforcing the Jordanian law of defense. The Jordanian law of defense has several legal effects. Such legal effects include: the right to education. This study sheds a light on the meaning of healthcare- administrative control and its impact on the right to education during exceptional conditions. To meet the study's goals, a descriptive analytical approach was adopted. An illustrative approach was adopted too. It was found that the Jordanian Constitution of 1952 and its amendments emphasize the significance of enjoying the right to education through articles No. 6, 9 and 20. The latter constitution acknowledges several international standards. Such standards include: equality, and avoiding discriminations in the field of education. The latter constitution acknowledges equality of opportunities in the field of education. It states that primary education is free and mandatory. Article 10 of the law of the Ministry of Education is consistent with article 20 of the Jordanian acknowledges. It states that primary education is mandatory for all Jordanians. However, by going back to the legislative texts that govern exceptional circumstances, there is no guarantee that the executive authority will not violate the right to education in the face of exceptional circumstances. The researcher suggests several recommendations. For instance, he recommends adding a text to the Jordanian constitution that emphasizes the right to education and the way of enjoying this right during exceptional conditions. This text should be added due the significance of this right and nature. It should be added to avoid any violation against the right to education during exceptional conditions which might occur due to the enforcing the law of defense for a long period of time. It should be added because the constitution is given priority over any other legislation. The constitution identifies the basic rights of individuals and sets guarantees for protecting such rights before the authority. It is given priority over the laws of lower rank in the legislative hierarchy. The study presented recommendations, the most prominent of which is that Parliament should monitor the decision to announce the work of the Defense Law and cancel its implementation in the event that the justifications for its continuation are no longer justified, in order to exercise its control over the conditions for declaring a state of emergency stipulated in the constitution, and the need to include this control in constitutional texts, so that Parliament can monitor the actions of The government during the implementation of the Defense Law in order to hold it accountable and withhold confidence from it if it exceeds its powers, or abuses its right, or it does not suspend the work of the Defense Law in the event that the justifications for declaring its implementation disappear, and it continues to work with it without justification
