الملخص بالعربية |
ذه الدراسة على حجية البصمة الوراثية في الإثبات الجزائي, ودورها في تكوين قناعة القاضي، كما وتعالج مشكلة أساسية على درجة كبيرة من الاهمية، وهي مدى إمكانية إستخدام البصمة الوراثية كبينة, أودليل قاطع في الإثبات الجزائي, وذلك في ظل العقبات العديدة التي تعترض طريق إستخدامها, ومن بينها إجبار المتهم على الخضوع لإجراء التحليل, ومدى المساس بحقه في خصوصيته الجينية وسلامة جسده, ومدى قانونية أو جواز أخذ عينة من الجثة قبل دفنها، إذ ان الدستور والقانون كفلا حق الأفراد في حماية أنفسهم وخصوصياتهم.
ولذلك تم تقسيم هذه الرسالة الى فصلين إثنين تناول الفصل الأول الإثبات الجزائي بالدليل العلمي وقواعد العمل بالبصمة الوراثية, وتم تقسيم هذا الفصل الى مبحثين, تناول المبحث الأول التعريف بالبصمة الوراثية وخصائصها. وتناول المبحث الثاني قواعد العمل بالبصمة الوراثية. اما الفصل الثاني, فقد تناول مزايا الإثبات بالبصمة الوراثية, وقد تم تقسيمه أيضا الى مبحثين، تناول المبحث الأول مجالات العمل بالبصمة الوراثية وشروط العمل بها. وتناول المبحث الثاني اشكاليات الإثبات الجزائي بالبصمة الوراثية، ومن ثم في الخاتمة تم تضمين أهم نتائج البحث وتوصياته.

This study focuses on in the (D.N.A) as an evidence In proving criminals materials, it has shown the biological sign effect and its role in proving the criminal materials, and then its role to create the judge believes therefore ; this study has been made in tow chapters,intermediate chapter: the type of biological signs and its relation with proving evidences, in the first chapter the biological sign has been limited through its meaning that could reach by using the exact meaning of the sign and biology, accordingly it has been defined as (a mark that can be sensed and examined where the main source is the human body, and related to one of the human biology actions starting from its anatomy, physiology, or it can be resulted from the normal habits).

The second chapter discussed the relation between the biological sign with proving evidence, I've made it clear that it?s an indirect and incomplete evidence that needs the usage of extraction and conclusion rules, in addition to other evidence that can be stand by the prove the crime bases and the criminal responsibilities of it.
I have discussed in chapter one the function of the biological sign in proving the charge in a primary part, I made it through proving the occurrence of the crime in all its bases, I have shown some examples that characterize the role of biological sign in proving the crime bases ; the material base. psychological base without the legal base; it was obvious that the biological sign has an important role in proving the rime result by considering the attitude as a complete action that does not stop at the crime initialization, where this has been proved through the biological sign, also what is related to the reason as it was possible to determine through the biological sign if the result is related to the action that has been done with example on this
