الملخص بالعربية |
تهدف هذه الدراسة إلى التعرف "مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية وحل المشكلة على تحديد مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية في القانون الأردني والكويتي وإيجاد مرتكزاتها القانونية وأسسا مدى اثر مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية من حيث التعهد بالالتزام بنصوصها والوسائل القضائية واستخراج وتقدير فاعليتها وطبيعتها القانونية وتأثيرها على سير العملية القضائية وخضوعها للقضاء الاداري.
يتناول موضوع اهمية مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية في القانون الأردني والقانون الكويتي، مما يجعل للبحث أهمية في الجانب النظري من خلال ما سوف يتناوله البحث من مراجعة مدى فاعلية الأثر القانوني المترتب على مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية في القانون الأردني والقانون الكويتي، إلى جانب فتح المجال أمام دراسات مستقبلية موضوع مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية في القانون الأردني والقانون الكويتي.
وفي هذه الدراسة على بحث مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية في القانون الأردني والقانون الكويتي، ومدى توافر البيئة القانونية لها، وما إذا كان هناك تشريعات ناظمة لها ومدى قبولها وتوافقها مع القوانين وأنظمة مسؤولية الإدارة عن الضرر المادي وتطبيقاته القضائية في القانون الأردني والقانون الكويتي وحقوق الإفراد بها
وتوصلت الدراسة الى اهم النتائج والتوصيات، ومن أهم التوصيات التي أوصى بها الباحث:
1- سن تشريع خاص بمسؤولية الإدارة بعين القضاء الإداري على رسم معالم نظرية المسؤولية الإدارية.
2- توحيد الاجتهادات القضائية التي تصدر عن محاكم القضاء الإداري.
3- وضع قواعد قانونية خاصة بتعويض الأفراد عن مسؤولية الإدارة، على أن تتسم هذه القواعد بخصوصية تميزها عن قاعد التعويض المقررة في القانون المدني.

This study aims to identify "Management's responsibility for physical damage and judicial applications and problem-solving to determine the responsibility of the Department for physical damage judiciary and its applications in the Jordanian law and Kuwait and to find legal Mrtkzadtha and foundations over the impact of management's responsibility for physical damage judiciary and its applications in terms of the pledge to abide by their provisions and judicial means, extraction and estimation effectiveness and legal nature and its impact on the functioning of the judicial process and to eliminate the administrative subordination.
It focuses on the importance of management's responsibility for the damage of physical and judicial applications in Jordanian law Kuwaiti law, which makes the search importance in the theoretical side through what will be addressed in search of a review of the effectiveness of the legal impact of the administration responsible for the physical damage and judicial applications in Jordanian law Kuwaiti law, Besides opening the way for future studies the subject of management's responsibility for the damage of physical and judicial applications in Jordanian law Kuwaiti law.

The study found the most important findings and recommendations, and the most important recommendations recommended by the researcher:
1. Enact legislation that is responsible for administration into the administrative court to draw the theory of administrative responsibility landmarks.
2. unification of jurisprudence issued by the administrative courts.
3. Develop private individuals to compensate for the responsibility of management of legal rules, to be characterized by the specificity of these rules distinguish them from sitting compensation prescribed in the Civil Code
