الملخص بالعربية |
لقد تناول الباحث موضوع تأجير المحل التجاري كدراسة مقارنة بين التشريعين الاردني والكويتي وفق إشكالية هامة تتلخص في مدى إمكانية تأجير المحل التجاري أو تأجير احد عناصرة محاولة من الباحث للاجابة على هذه الاشكالية فقد بين مفهوم المحل التجاري مبرزاً طبيعته القانونية ومحدداً لعناصرة المادية ولقد توصل الباحث إلى عدة نتائج كان اهمها ان المحل التجاري عبارة عن مال منقول مستقلاً بذاته بما يحتوية من عناصر تشكل فيما بينها ما يسمى بنظرية المحل التجاري اضافة إلى انه لا يشترط توافر جميع هذه العناصر لضمان صحة تأجير المحل التجاري بل يكفي توافر بعضها فقط، وامام ذلك فقد اوصى الباحث بعدة توصيات كان من اهمها ضرورة تعديل النصوص المتعلقة بتأجير المحل التجاري في القانونين الاردني والكويتي بما يكفل تأجير المحل التجاري أو بعض عناصرة دون أي ضرر أو مسؤولية على طرفي عقد التاجير |

I have dealt with researcher subject of business premises rental as a study a comparison between the Jordanian and Kuwaiti pieces of legislation in accordance with the important problem boils down to the possibility of business premises rental or lease of one of its elements an attempt by the researcher to answer this dilemma was between the concept of the business, highlighting the legal nature and specific physical elements and has the researcher suggested several the results of the most important was that the business is a movable property, autonomous including addition elements make up the so-called theory of the business in addition to that it does not require the availability of all these elements to ensure the health of the business renting it is sufficient availability of only some of them, and in front of it was the researcher recommended several recommendations among which was the need to amend the provisions relating to the rental of business premises in the Jordanian and Kuwaiti laws to ensure the rental of the business or some of its elements without any damage or responsibility on both ends of this lease |
