الملخص بالعربية |
هدفت هذه الدراسة إلى تسليط الضوء على ضمانات تنفيذ الأحكام القضائية الإدارية، وذلك من خلال دراسة مقارنة بين القانون الأردني والكويتي. اعتمدت الدراسة في الإجابة على الإشكالية المطروحة على أسلوب البحث النوعي في تحليل النصوص القانونية التي تناولت هذه الضمانات، كما قامت الدراسة بتحليل مضمون أحكام القضاء المتعلقة بموضوعها في القانون الكويتي والأردني.
وخلصت هذه الدراسة إلى عدد من النتائج أهمها: أن المشرع الأردني قد أخذ بنظام القضاء المزدوج، في حين اكتفى المشرع الكويتي بوجود دائرة أو غرفة خاصة ضمن القضاء العادي على الأقل تتولى النظر في المنازعات الإدارية إلى حين تدعوا الحاجة إلى إنشاء القضاء الإداري المستقل.
وأوصت الدراسة بضرورة أن يتبنى المشرع الأردني والكويتي نصاً يمنح القاضي الإداري سلطة توجيه أوامر للإدارة، وذلك كما ذهب المشرع في فرنسا، والاسترشاد بالحلول التي تبناها المشرع الفرنسي في هذا المجال.

This study aimed to shed light on the guarantees of implementation of the administrative judicial decisions, through a comparative study between the Kuwaiti and Jordanian law. The study adopted in answer to the problem before the method of qualitative research in the legal texts that dealt with the analysis of these guarantees, as the study analyzes the content of court rulings related to the merits of the Kuwaiti and Jordanian law.
This study concluded that a number of the most important results: the Jordanian legislator has taken a dual justice system, while only Kuwaiti legislature the existence of a circle or a private room within the normal judiciary shall at least consider the administrative disputes while to let the need to establish an independent administrative court.
The study recommended the need to adopt the Jordanian and Kuwaiti legislator text gives the administrative judge orders directing the management authority , and it went as legislator in France , and guided by the solutions adopted by the French legislator in this area
