الملخص بالعربية |
أن أهميته نظرية الظروف الاستثنائية ومدى الحاجة إليها عندما يصبح كيان الدولة في خطر، ويكون المجتمع بأسره مهددا بالفوضى، لهذا فقد وجدت نظرية الظروف الاستثنائية لتواجه تلك الظروف الشاذة في حياة الدولة التي تهدد كيانها وأمنها، مما يترتب على هذه النظرية تخويل السلطة التنفيذية باتخاذ الإجراءات والتدابير اللازمة من اجل المحافظة على كيان الدولة وسلامتها مهما تضمنت من اعتداء على الحقوق والحريات الشخصية، وقد يودى ذلك إلى الانحراف في استعمال السلطة.
السلطات الخطيرة التي تقوم بممارستها السلطة التنفيذية في ظل الظروف الاستثنائية والتي سلم بها القضاء، قد استلزم لإعمال تلك الإجراءات الاستثنائية عدة شروط يكون الهدف منها حماية الحقوق والحريات الشخصية ضد أي مساس غير قانوني و شرعي يتجاوز الحدود المنصوص له.
لذا يجب صياغة أسباب إعلان حالة الطوارئ في قوالب واضحة المعنى بحيث لا تقبل التفسير أو التأويل الذي يفسح المجال أمام السلطة التنفيذية في ابتداع أسباب جديدة. والنص في قانون الطوارئ على وجوب موافقة السلطة التنفيذية والتشريعية سويا على إقرار إعلان حالة الطوارئ وعدم حصر ذلك بالسلطة التنفيذية لما لهذا القانون من أثر واضح على الحقوق والحريات الشخصية وكون أن السلطة التشريعية هي ممثلة المواطنين في تشريع القوانين التي تخدم الأشخاص والمصلحة العامة.
