الملخص بالعربية |
تناولت هذه الدراسة موضوع الجهود الدولية لمكافحة جريمة الإتجار بالبشر باعتبارها من (الجرائم المنظمة عبر الوطنية) ذات الخطورة البالغة لإرتباطها المباشر بحقوق الإنسان، حيث هدفت الدراسة إلى بيان الجهود الدولية لمكافحة الإتجار بالبشر، من خلال المعاهدات والإتفاقيات الدولية وآليات تفعيل تلك الإتفاقيات ووضعها موضع التطبيق، و بيان مدى اهتمام المجتمع الدولي بضحايا الإتجار وآليات تقديم الدعم وتوفير الحماية لهم.
فقد ركزت الدراسة على أهم الجهود الدولية الرامية للحد هذه الجريمة، وكذلك سلطت الضوء على الآليات الدولية الضامنة لعدم إنتهاك حقوق الإنسان، وأهم وسائل الدعم لضحايا الإتجار بالبشر وتقديم الدعم لهم.
ومن أهم ماتوصلت أليه الدراسة أن هذه الجريمة من الجرائم المنظمة عبر الوطنية، حيث تقوم بها عصابات احترفت الإجرام، أضافةً لذلك إن الضحايا في أغلب الأحوال يتم المتاجرة بهم من دولة إلى أخرى، وكذلك ما أحرزت الأمم المتحدة في بناء إطار قانوني، ومؤسسي للمعايير الدولية بشأن مكافحة جريمة الإتجار بالبشر من خلال سلسلة من الإتفاقيات والبروتوكولات. أما عن التوصيات التي توصلت إليها الدراسة فهي الحث على التعأون الدولي في ميدان مكافحة هذه الظاهرة وإبرام العديد من الإتفاقيات الثنائية ومتعددة الأطراف في هذا الجانب متضمنة أهم أشكال التعأون بين الدول، لمحاربة هذه الجريمة ومعاقبة مرتكبيها.

The researcher in this study has discussed international efforts to combating trafficking in human beings, it is one of the most important organized crimes. The crime of human trafficking has described as the extreme gravity, this is because the crime of human trafficking link to human rights. The current study aimed to investigate of international efforts to combating trafficking in human beings, through international treaties and conventions, and mechanisms of activating these agreements and put them into practice. Moreover, the study aimed to identify the extent of care the international community about victims of trafficking and the mechanics of providing support and protection for them. Finally, the study also aimed to provide a source for the professionals in the field of combating trafficking in human beings.
The study discussed the international legal framework for the crime of human trafficking, the concept of trafficking in human beings, its nature and forms and the difference between it and similar crimes, the most important agreements that prohibited this type of crime, international mechanisms that sure the lack of human rights violations, and the most important means of support for victims of human trafficking and how provide support to them. As a conclusion, the most important results are the crime of human trafficking is one of the transnational organized crimes. It carried out by gangs, and they became a professional in the crimes. Also, they have taken it as an active professionally for profits, where it is one of the most crimes that achieve profit after arms and drugs trade. In addition, the United Nations has made significant progress in the field of a legal framework, and the establishment of international standards on combating trafficking in human beings. This is through a series of conventions and protocols. One of the most important of conventions and protocols is the United Nations convention against transnational organized crime - protocol I to prevent, suppress and punish combating trafficking in human, especially women and children.
Finally, this study recommended to the need to urging the international cooperation in the field to combat this phenomenon. The need to the conclusion of several bilateral and multilateral agreements in this regard, including the most important forms of cooperation between the countries. In addition, the need to encourage sharing of data and experience among security and judicial organs between different countries in the light of applicable laws framework.
