الملخص بالعربية |
تتحدث هذه الدراسة عن موضوع الإخبار عن الفساد الإداري، وتهدف إلى بيان أصل وجوده، من خلال التعرف على مفهومه، والأساس التشريعي له في التشريعات الأردنية والاتفاقيات الدولية ذات الصلة بمكافحة الفساد فجاءت الدراسة في مقدمة وفصلين وخاتمة.
حيث جاء في المقدمة ذكر مشكلة الدراسة وهي: ما مدى تأصيل الإخبار عن الفساد الإداري في التشريعات الأردنية والاتفاقيات الدولية ذات العلاقة في مكافحة الفساد؟
وجاء الفصل الأول بالحديث عن مفهوم الإخبار عن الفساد الإداري وبيان السلطات المختصة بتلقي الإخبارات والطبيعة القانونية للإخبار عن الفساد الإداري والجرائم التي قد تنشأ عن تقديم الإخبار عن الفساد الإداري.
وتركز الحديث في الفصل الثاني عن الأساس التشريعي للحق في الإخبار عن الفساد الإداري سواء في الاتفاقيات الدولية ذات الصلة بمكافحة الفساد وهي اتفاقية الأمم المتحدة لمكافحة الفساد لعام 2003 والاتفاقية العربية لمكافحة الفساد لعام 2012 والتي صادقت عليها الحكومة الأردنية. أو في التشريعات الأردنية وكل ذلك في المبحث الأول، بينما جاء المبحث الثاني ليبين الآثار القانونية الموضوعية والإجرائية المترتبة على تقديم الإخبار عن الفساد الإداري للجهات المختصة.
ثم خلصت الرسالة إلى الخاتمة التي اشتملت على أهم النتائج التي تمثلت بان هناك أساساً قانونياً وتشريعياً لحق الفرد في الإخبار عن الفساد الإداري عن طريق الإخبار والشكوى والتظلم إلى السلطات المختصة وكذلك تم توفير الحماية لمقدم الإخبار عن الفساد الإداري بالإضافة إلى الشهود والمخبرين والخبراء وأقاربهم والأشخاص وثيقي الصلة بهم وتم النص عليه في قانون النزاهة ومكافحة الفساد رقم (13) لسنة 2016 مع توسيع دائرة منح الأعذار المخففة والمحلّة لمن يبادر من الجناة الفاعلين أو الشركاء أو المتدخلين في قضايا الفساد الإداري في تقديم الإخبار عنه للجهات المختصة.
واشتملت الخاتمة على أهم التوصيات المتمثلة بضرورة النص على مكافأة مالية للأفراد وحوافز للموظفين العامين لتشجيعهم على تقديم الإخبارات عن الفساد الإداري وتوعية الأفراد عن الحق في الإخبار عن الجرائم بشكل عام وجرائم الفساد والفساد الإداري بشكل خاص

This study is talking about the subject of reporting about administrative corruption, it aims to explaining its legislative framework by recognizing the concept, the legislative basis for it in the Jordanian legislation related to combating corruption and international conventions. This study consists of an introduction and two chapters and a conclusion.
The introduction had the problem of the study:
What is the origin of the right in the reporting about legislative corruption in the Jordanian legislation and international conventions?
The first chapter is talking about the concept of reporting about administrative corruption and distinguishes it from other inferences and the authorities to receive reports and legal nature of the reporting about administrative corruption.
The second Chapter talks about the legislative basis of the right in the reporting about administrative corruption both in the anti-corruption international conventions, its the United Nations Convention against Corruption in 2003 and Arab Convention against Corruption in 2012 that Jordanian state has indorsed , or in the Jordanian Constitution and the laws and regulations of Jordan and behavior rules code in careers and ethics of public office all in the first section, while the second section came to show the legal and procedural implications of presenting reporting about corruption to the authorities.
Then the letter ended to the conclusion, which included the most important results showed that there is a legal and legislative basis of the individual right in reporting about corruption by the reports, the complaint, and appeal to the authorities, as well as the provision of protection for the provider reports about administrative corruption in addition to witnesses and reporters, experts, relatives, and close friends.
Conclusion included the most important recommendations of the need to putting financial rewards for individuals and incentives for public officials to encourage them to provide reports about administrative corruption
