الحمد لله رب العالمين , والصلاة والسلام على أشرف الخلق والمرسلين , سيدنا محمد صلى الله عليه وسلم وعلى آله وصحبه أجمعين , ومن تبعهم بإحسان وسار على نهجهم إلى يوم الدين ، وبعد :
فقد استعرضت في هذه الرسالة تعريف الاجتهاد لغةً واصطلاحاً ومشروعية الاجتهاد , ومفهوم فقه الواقع لغةً واصطلاحاً وتصوير فقه الواقع وتاريخفقهالواقع .
وبعد ذلك انتقلت للحديث عن قواعد الاجتهاد في الإسلام , تحدثت عن أركان الاجتهاد وشروط المجتهد ومراتب المجتهدين , وذكرت بعض قواعد الاجتهاد وتطرقت الى أهمية الاجتهاد عند المسلمين .
واستعرضت موضوع أثر فقه الواقع في الاجتهاد , وعلاقة المصلحة في الاجتهاد في ظل متغيرات الحياة , وتحدثت فيه عن بعض التطبيقات المعاصرة وأثر فقه الواقع في هذه المسائل .
وأخيراً ناقشت أهم النتائج التي توصلت إليها من هذا البحث في الخاتمة , وبيان أهمية الاجتهاد مع متغيرات العصر , وأهمية فقه الواقع لرفع الضيق والحرج عن الناس

الملخص بالانجليزي |
Praise be to Allah, and peace and blessings be upon His creation and messengers, the Prophet Muhammad, peace be upon him and his family and companions, the Almighty and marched on their way to the Day of Judgment. After: This thesis is divided into introduction, three chapters and a conclusion: The first chapter which is the introductory chapter contains two sections, and under every section, there are several demands. The first section contains a definition of diligence language; idiomatically and legitimacy. The second section contains the concept of reality jurisprudence literary and idiomatically. It depends in relating jurisprudence and the words of the relevant jurisprudence to reality , finally, it discusses the appearance of the jurisprudence of historical fact. The second chapter to talk about the rules of jurisprudence in Islam, this chapter contains two topics and there are several topics under each one. First of all, this chapter talks about the pillars of jurisprudence in Islam, conditions of jurisprudents and their ranking. The second section states some rules of jurisprudence and touches on the importance of jurisprudence for Muslims. The third chapter is divided in two sections. In the first part, it talks about the impact of the jurisprudence of reality in the diligence, and the relationship of interest in jurisprudence in the light of the variables of life. The second section talks about some contemporary applications and the impact of the jurisprudence of reality in these matters. Finally, I discussed the most important findings of this thesis in the conclusion, and the importance of jurisprudence with the variables of the lifetime, and the importance of the jurisprudence of reality to raise the distress and embarrassment for people |
