بينت الدراسة الضوابط الدستورية لإصدار التشريع الحكومي أثناء غيبة البرلمان دراسة مقارنة بين التشريع الكويتي والتشريع الأردني، وقد استندت الدراسة إلى مجموعة من القواعد القانونية الصادرة في القوانين المؤقتة، أو مراسيم الضرورة.
وقد تناول الباحث تفسير المادة (71) من القانون الدستوري الكويتي مقارنة بالتشريعات الأردنية التي تناولت العملية الانتخابية وأهمها المادة (94) لأحكام الدستور الأردني لسنة 1952 ، والتي تناولت الحق الدستوري في إصدار مراسيم الضرورة أو قوانين مؤقتة.
وقد توصلت الدراسة إلى أنه يحق للسلطة التنفيذية حق التشريع خلال فترة حل مجلس الأمة أو مجلس النواب وقد حددها المشرع الكويتي بمدة لا تتجاوز الشهرين من تاريخ إجراء الحل، والمشرع الأردني بمدة لا تتجاوز أربعة أشهر من تاريخ إجراء الحل.

The researcher has addressed the explanation of article (17) of the Kuwaiti constitutional law compared to the Jordanian legislations that have addressed the election process, the most important article is (94) of the Jordanian constitution rules for the year 1952 that dealt with the constitutional right is issuing the necessary acts or temporary laws.
He study reached that the executive authority has the right to legislate during the work out of the people's assembly or the house of representation that the Kuwaiti legislator determined by a period that does not exceed two months from the data of the work out procedure, and the Jordanian legislator by a period that dies not exceed four months from the date of the work out procedure
