الملخص بالعربية |
ناقشت هذه الدراسة موضوع الأحكام الفقهية المتعلقة بالحر والقر، وذلك لبيان الحكم الشرعي في كل مسألة.
وكمدخل للدراسة عرف الباحث المقصود بالأحكام الفقهية، والمقصود بالحر والقر، من جهة اللغة والشرع، ثم بعد ذلك بين الباحث علاقة الحر والقر بالأحكام الفقهية، وكيف يغير الحر والقر الحكم الشرعي، فينقل الحكم من الإباحة إلى التحريم وغير ذلك.
وقام الباحث بتخصيص فصل تم فيه ذكر المسائل المتعلقة بالحر والقر في باب العبادلت، وهناك مسائل متفرقة تم ذكرها في فصل مستقل بعنوان مسائل متفرقة في الحر والقر، ذلك كمسألة إقامة الحدود والتعازير، ومسالة العمال والخدم في الحر والقر، ومسالة الترك في الحر أو القر (الجريمة السلبية)، ومسألة سب الحر.
وخلُص الباحث إلى أن تأثير الحر والقر في الأحكام الفقهية إنما هو من باب دفع الضرر والمشقة التي يمكن أن تمس الإنسان.
وأخيرا ذكر الباحث جملة من التوصيات التي يراها ضرورية في تثقيف المسلمين حول الأحكام التي لها علاقة بالحر والقر فتخفف عنهم كثير من المشاق.

This study discussed the subject of heat-related jurisprudence and loan, and so as to indicate the ruling on each issue.
And as an introduction to the study the researcher knew the meaning of the provisions of jurisprudence, and heat-intended and loan, on the one hand language and Shara, and then said researcher group of Quranic verses and hadith which dealt with the subject of the free and the loan together with the interpretation and explained to her.
The relationship between the researcher and the free loan provisions jurisprudence, and how it changes the free loan and legitimate rule, conveys judgment of the permissibility to prohibition, and so on.
