الملخص بالعربية |
تناولت الدراسة في مجملها نظرة فقهية تأصيلية لأحكام المسعفين وتكييف شرعي لأعمالهم ممزوج بمجموعة من الضوابط والقواعد الفقهية المنظمة لهذا الأمر لتكون مثابة دليل شرعي يحتذي به المسعفون أثناء تأديتهم لمهام وظيفتهم.
وأخذت الدراسة على عاتقها بيان الأحكام الشرعية التي تعتري عمل المسعفين باعتبار أنها مهنة تاريخية من فروض الكفايات وذات أصالة وأهمية شديدة والحاجة الماسة بدليل تواجدها في العهد النبوي وقيام بعض الصحابة بها.
وألقت الدراسة ضلالاً على الأحكام المتعلقة بعبادات المسعفين من صلاة وصيام وحج وزكاة وظهرت روعة الشريعة الغراء في المحافظة على النفس وتيسيرها للمسعفين، وكأن الجامع في هذا كله هو يسر الاسلام ونظرته الى الانسان كقيمة تحترم وكيان يحفظ ويصان، فما من شأنه العمل على هذا فقد أيده الاسلام ودعا إليه موسعاً من نطاق الضرورة في هذا الأمر وبخاصة إذا ترتب على الترخص بها حفظ حياة من الموت أو صيانة عضو من التلف.
كما حرصت الدراسة عل بيان حكمة الشريعة في تقدير المسؤولية ومحاسبة المقصر من خلال الحديث عن مسؤولية المسعفين عن أعمالهم وموجباتها والأثار المترتبة على ثبوت موجبات هذه المسؤولية من نحو القصاص في حالة الوفاة الناتجة عن الاعتداء العمد، والضمان بما يتبعه من دية أو أرش أو حكومة وفقاً لصورة التلف، والعزير في حالة إذا كانت المسؤولية ناتجة عن مخالفة أصول المهنة أو الجهل بها.
وقد انتهت الدراسة غلى مجموعة من النتائج والتوصيات التي توضح مظاهر يسر الشريعة الغراء، وتدعو الى ضرورة الاعتناء بالمسعفين وإقامة دورات علمية شرعية لهم تتيح لهم معرفة الضوابط الشرعية اللازمة لعملهم وتحفيزهم وبث روح التنافس بينهم بوضع قانون يكافئ المسعف الأكثر إخلاصا وسرعة واتقاناً في عمله وانجازاً له على الوجه المطلوب سواء كان عن طريق الحافز المادي أو الوظيفي.

This study handles the provisions of jurisprudence related to paramedical staff. Study summarizes the Fundamentals of Islamic Jurisprudence of provisions of paramedical staff and legal adoption for their work merged with group of disciplines and rules of jurisprudence, which regulate such matter to become a legal evidence, which the paramedical staff can perform during their job or their message.
The core of the study is consolidation for volunteering spirit and helping indigent in Islamic societies.
The study clarified the legal provisions regarding work of paramedical staff considering that it is a very important historic profession of Collective obligations. There is need to such profession and the evidence is that this profession has existed in the prophetic age and some companions of the prophet were paramedical staff.
The study clarified the provisions related to worship of paramedical staff such as prayer, Zakat and Hajj. It shows the magnificence of Sharia in maintaining the individuals and facilitating such worships for paramedical staff to perform their message perfectly. Islam simplifies all such things, which Islam is performing, and the view of the Islam to human being as a respected value and protected entity. Islam supports and invites to such work widely from the respect of necessity in such thing. Especially if licensing such work keeping a life from death or maintaining an organ form defect. The study did not neglect looking to paramedical staff from the same direction. Therefore it has set for him rights and ensured for him and for his family a due against what he can face during his service.
The study ensured to identify the judiciousness of Sharia in estimating the responsibility and judging the negligent during speaking about responsibility of paramedical staff for their profession, dues and effects arising from dues of such responsibilities such as retaliation in case of death arising from knowingly assault and insurance such as blood money or government according to ratio of deficiency and censure if the responsibility arising from violation of foundations of profession or negligence or mistake in performing first aid.
The study reached to group of results and recommendations which clarifies the features of simplicity of Islam and invites to necessity of caring of paramedical staff and presenting legal scientific courses for them which allows them to know the necessary legal disciplines and motivating them and spreading the competitive spirit between them by setting a law which rewarding the most honest, fast, accurate and achiever paramedical staff by financial or professional motivation. Islamic jurisprudence conducts paramedical staff to legal provision of the issues which he face during his work. His work is not out of legal objectives and legal commissioned person.
