لقد تناولت دراسة المحكمة الدستورية وآلية اتصالها بالدعوى وهي "دراسة مقارنة" والتي تدور حول الرقابة على دستورية القوانين والأنظمة في المملكة الأردنية الهاشمية, والتحول الحاصل في الرقابة على دستورية القوانين والأنظمة من الرقابة اللامركزية إلى الرقابة المركزية, وفقاً للتعديلات الدستورية التي أجريت على مواد الدستور الأردني لسنة (2011) واستحدثت المحكمة الدستورية الأردنية, وبينت هذه الدراسة المحكمة الدستورية الأردنية من حيث تشكيلها, واختصاصها, وشروط العضوية وضمانات أعضائها, وأوجه الطعن بعدم الدستورية ومحله, وآلية الاتصال بالدعوى الدستورية, حيث خلص الباحث إلى أن القضاء الدستوري في الأردن على الرغم من قدومه متأخراً إلا انه شكل ضمانة أساسية لحماية الحقوق والحريات في المجتمع الأردني, كما وضع حداً لكل من تسول له نفسه أن يعبث بالعقد المبرم بين الشعب والحاكم, ألا وهو الدستور. |

This study addressed the issue of the methods of the relation between the Constitutional Court and the case " A Comparative Study" supervision on the constitutionality of laws and regulations in the Hashemite Kingdom of Jordan, and the transformation which happened in the supervision on the constitutionality of laws and regulations from decentralized supervision to centralized supervision, according to the constitutional amendments, which were held on the Jordanian Constitution since (2011) and the constitutional Court of Jordan introduced and showed in this study the Jordanian constitutional Court in terms of formation, and competence, and membership conditions and guarantees of its members, and aspects of the appeal of unconstitutionality and its validity, and the methods which related to the constitutional case, where the researcher concluded that the constitutional judiciary in Jordan, although coming late, but he had formed an essential safeguard to protect the rights and freedoms in the Jordanian society, also put an end to all whom want to tampering in the contract between the people and the ruling, which is the Constitution |
