الملخص بالعربية

كي تكون الديمقراطية فعالة ينبغي أن تكون الحكومة مستجيبة لمتطلبات الأفراد. فحق الحصول على المعلومات يعتبر أوكسجين الديمقراطية، فلا بد من تنوير المواطنين والسماح لهم في الوصول إلى المعلومات. على الرغم من ان حق الحصول على المعلومات ليس مطلقا فهو محكوم بقيود وضوابط من اجل المصلحة العامة. ولقد اعتبرت المملكة الأردنية الهاشمية أول دولة عربية تقر حق المواطن الاردني في الوصول إلى المعلومات، وعند تقيم التجربة الاردنية في مجال حق الوصول الى المعرفة، كان لابد من فحص قانونها إن كان يوفر اساسا جيدا لممارسة هذا الحق، وهل حقق اقصى درجات الشفافية والانفتاح واخضاع القانون لمعايير الشرعة الدولية. المتفق عليها في تحديد مضمون هذا الحق ونطاقه والضمانات التي تحيط به. ولقد قسمت هذه الدراسة الى فصلين تعلق الفصل الاول بالجانب النظري لحق الحصول على المعلومات، اما الفصل الثاني فكان مكون من جانبين تعلق الجانب الأول بالشرعة الدولية لحقوق الإنسان، والجانب الاخر تم اخذ التجربة الأردنية وما يحيط بها من ضمانات واجراءات الحصول على المعلومات. وخلصت الدراسة بعدة نتائج وتوصيات كان من اهمها ضرورة تعديل قانون حق الحصول على المعلومات الاردني رقم 43 لسنة 2007 ليتوافق مع الشرعة الدولية لحقوق الانسان وغيرها من التوصيات والنتائج.

Abstract

In order to be effective democratic government should be responsive to the requirements of individuals. The right of access to information is the oxygen of democracy, we must inform citizens and allow them to access information. Although the right of access to information is not absolute, it is doomed restrictions and controls for the public interest. We have considered the Hashemite Kingdom of Jordan the first Arab country to recognize the right of the Jordanian citizen's access to information, and when you evaluate the Jordanian experience in the field of access to knowledge, it was necessary to examine the law if it provides a good basis for the exercise of this right, and whether made utmost transparency and openness and subdue law international standards Bill. It agreed in determining the content and scope of this right and guarantees that surround it. The study was divided into two classes attached to Chapter One aspect of the theoretical right of access to information, while the second quarter was made up of two attached to the first side of the international charter, human rights, the other side has been taking the Jordanian experience and Mahristit out of safeguards and the procedures for obtaining the information. The study concluded that a number of findings and recommendations among which was the need to amend the right of access to the Jordanian Information Act No. 43 of 2007 to comply with the International Bill of Human Rights and other recommendations and results
