الملخص بالعربية |
جاءت هذه الدراسة لتسليط الضوء على أهمية مراعاة الأكثرية في الشريعة الإسلامية والتشريع الأردني, حيث وقفت في الفصل الاول على تعريف الأكثرية لغة واصطلاحاً,وعرجت على تاريخ الأكثرية عند الرومان واليونان ,وكيف أنهم كانوا يولونها أهمية بالغة في مؤسسة الحكم وتداول السلطة , وبعد ذلك اخترت ايات من كتاب الله عز وجل دلت على أهمية الأكثرية عند الأمم السابقة ,وأوردت قصة ملكة سبأ, وصراع فرعون وموسى عليه السلام.
وفي الفصل الثاني بينت التطبيقات الشرعية والقانونية لمسالة الأكثرية ,وذلك من القران الكريم والسنة النبوية، ومن مواد الدستور الأردني.
وفي الفصل الثالث أدرجت الاختلاف القائم بين الفقهاء فيما يخص مسالة إلزامية الشورى من عدمها, وذلك تمهيداً لبيان التأصيل الفقهي لهذه المسالة, إذ لا بد من معرفة مدى إلزامية الشورى أولا وأنها واجبة على الحاكم, وهذا يتضمن القول برأي الأكثرية وبيان أصل مسالة الأكثرية في الشريعة.
ومن ثم اجتهدت في توضيح ضوابط الأكثرية المراده ,التي تعزلها عن غيرها من الاكثريات, وتوضح ما هي الأكثرية المعتبرة في الشرع ,وبعدها بينت اثار العمل بمبدأ الأكثرية.
وفي الخاتمه توصلت لنتائج الدراسة.

The issue of the majority in legislations is considered one of the important issues in the balancing of parliamentary work. This study aims at spotting the light on the importance of considerateness of the majority in Islamic Sharia and Jordanian legislation, where I dedicated the introductory chapter to define the majority, both linguistically and conventionally, and I bent to the history of the majority among the Romans and the Greek, and how they gave it a lot deal of importance under reign establishment and authority circulation, then I chose some bright stages from the Holy Quran that demonstrated the importance of the majority for past civilizations, and instanced the story of Saba Queen and the conflict between Pharaoh and Moses, peace be upon him.
In the following chapter I manifested the legislative and legal applications for the issue of the majority from the Holy Quran and Prophet Mohammad's Sunna, and from Jordanian Constitution rules.
And in the third chapter I included the prevalent disagreement among jurists related to the issue of whether consultation is compulsive or not, as a prelude to show the legislator rooting for this issue as it is crucial to reveal the extent of whether consultation is compulsive or not, and whether it is dutiful for the ruler and this includes taking the attitude of the majority into consideration and explaining the attitude of the origin of the majority issue in Sharia, and I revealed the preponderant attitude, then I tried to clarify the regulations of the majority that displaces it from other majorities and clarifying what the presumed majority in legislation is. Then I mentioned the benefits of work according to the principle of the majority, and after that I came up with findings emerged into this study as well as one recommendation
