الملخص بالعربية |
تناولت هذه الدراسة منازعات الوظيفة العامة والوظيفة الدولية في اطار القانون الوطني والقانون الدولي "دراسة مقارنة" , وبرزت مشكلة الدراسة في منازعات الوظيفة العامة الوطنية والدولية من الواقع المعاصر الذي كثرت فيه الاسئلة حول ماهية القضاء الاداري الوطني والقضاء الاداري الدولي ومعرفة اجراءات التقاضي امام كل منهما , ومدد الطعن وطرقه, والمحاكم ذات الاختصاص. واهمية الدراسة تعود الى ان منازعات الوظيفة العامة الوطنية والدولية من الامور التي يحتاجها الناس في حياتهم اليومية ,مع كثرة الوظائف العامة ,اضافة الى ان موضوع الوظيفة مهم لمؤسسات القضاء بمختلف انواعها , وهدفت الدراسة الى التعريف بالوظيفة العامة الوطنية والدولية ,وبيان المحكمة المختصة التي يرفع النزاع امامها, وبيان طرق ومدد الطعن امام تلك الجهة, وتوصلت الدراسة الى ان مجلس الدولة المصري هو المختص بمنازعات الادارة مع موظفيها ,وفي الاردن فان محكمة العدل العليا هي المختصه بمنازعات الموظفين مع الادارة , وعلى الجانب الدولي تختص المحكمة الادارية للأمم المتحدة بالمنازعات التي تنشب بين الموظفيين الدوليين ومنظماتهم الدولية. |

This study discusses the disputes of public and international job in the context of national and international law. So the problem of the study appears with the disputes of the public national job and international job from contemporary reality which abounded many questions in about essence of the national administrative judiciary and of the international administrative judiciary and knowledge of litigation in, the period and styles of appeal, and the courts of jurisdiction. The importance of the study is because the disputes of national and international public jobs are important for people in their daily lives with the abounding of public jobs, as well as the subject of the job is important for all kinds of justice institutions. The aim of the study is to define the national and international public job, the statement of the competent court in which the conflict , and the statement of the period and styles of appeal. The study found that the jurisdiction of the Egyptian State Council disputes with staff management and the judicial section of the Council, Jurisdiction of the Supreme Court of Justice of Jordan disputes with management staff in Jordan, and on the other side the administrative court of the United Nations international administrative disputes , which arise between the international staff and international organizations |
