الملخص بالعربية |
تهدف هذه الدراسة الى مفهوم العقد الباطل في الزواج عند الفقهاء والقانون. وبعد ذلك, بيان حالات العقد الباطل التي ذكرت في المواد قانون الأحوال الشخصية الأردني متوافقا شرعيا بالفقه المذاهب الأربعة والقانون. منها تزوج الرجل بمن تحرم عليه على التأبيد بسبب النسب او المصاهرة و أيضا تزوج الرجل بزوجة الغير او معتدته و أيضا تزوج المسلم بامرأة غير كتابية و أيضا تزوج المسلمة بغير المسلم التي يحرم العقد عليها.
وقد اتفق فيها الفقهاء والقانون أن هذه الحالات لا بد ان يبطل العقد الزواج ويعتبر كعدمه لأن فقدان ركن من أركان العقد الزواج.
وهذه الدراسة يبين فيه الحكم والأدلة والترجيح عند الفقهاء المذاهب الأربعة متوافقة بالقانون للحالات الأربعة المذكور في نصوص القانون وللنصوص الأخرى يؤخذ ويرجح فيه المحكمة من المذهب أبو حنيفة.

The study revealed the cases in which the contract is prohibited which the Holy Qur?an refers to and that this forbidden relationship is one of the conditions for the validity of the marriage and that the marriage contract is not forbidden to anyone who wants to marry it for any reason . These are cases where the contract is void .
The study dealt with what is forbidden to a Muslim woman contract,permanent sanctity and women who are bound by the association of kinship or marriage or breast-feeding , as well as a sanctity with the presence of the bidder wife of others and f habitual and launched three times before the marriage of other spouses, and to marry her, between the Jordanian Personal Status Law No. 36 of 2010 and the sayings of jurists were compatible, achieving the interests of the family and community building .
And this sanctity either because it is enjoined by the positive texts of the link of the uterus end the righteousness of the parents and charity by them or to do so mind or consensus and the number of relatives of the analysts,because HE said : and I have cleared you beyond that
