الملخص بالعربية |
هدفت هذه الدراسة إلى بيان مدى كفاية القانون الأردني و القوانين المقارنة حماية المنتج من العيوب الخفية التي يقع فيها الصانع , عند التقصير في جودة الإنتاج و هنا تحدث المسؤولية المدنية التي تعد المحور الأساسي لهذه الدراسة .
تعرضت الدراسات التي تكلمت بهذا الأمر إلى بيان المسؤولية الجزائية للمنتج و تحديد أثر هذه المسؤولية و دفعها إلا أن هذه الدراسة عملت على بيان المسؤولية المدنية للصانع , و ذلك بهدف الإحاطة بجوانب المسؤولية الدائرة حول المنتجات و صانعيها , توصلنا في نهاية هذه الدراسة إلى أنه يجب على أي نظام تشريعي في العالم أن يقوم بتوفير أكبر قدر ممكن من وسائل الحماية للمستهلكين وأن ياخذ بالمفاهيم الواسعة حتى يعطى هؤلاء و المستهلكين الحماية اللازمة و نتمنى من القضاء في ظل غياب النصوص التشريعيه الأخذ بفكرة فرض الالتزام العام بضمان السلامة على عاتق المنتج والبائع واعتباره التزاما قانونياً عاماً.

The aim of this study is to demonstrate the adequacy of Jordanian law and comparative laws to protect the product from the hidden defects in which the manufacturer, when the quality of production is deficient, and the civil responsibility which is the main focus of this study.
The studies that have dealt with this matter have been subjected to a statement of the criminal responsibility of the product and the determination of the impact of this responsibility, but this study has worked on the statement of the civil liability of the manufacturer, in order to take into account the aspects of the responsibility around products and their manufacturers , We concluded at the end of this study that any legislative system in the world must provide the greatest possible means of protection for consumers and take broad concepts to give them and consumers the necessary protection and we hope to eliminate in the absence of legislative texts to introduce the idea of imposing public commitment Ensure the safety of the product and the seller and consider it a general legal obligation.
