الملخص

الواجبات الشرعية المكلف بها المسلم لا بد من أدائها كما أرادها الشارع وتحقيق مقصدها الشرعي، والأداء من قِبل المكلف لا يخلو من السرعة في الامتثال أو التراخي والإهمال في الأداء، فالتعجيل في أداء التكاليف الشرعية عند الأصوليين دّل بمفهومه على معنيين للتعجيل وهما أداء الواجب أول وقته أو قبل وقته، ووافقهم في ذلك الفقهاء مع الاختلاف في اتجاهات العلماء في الأخذ بمعنى التعجيل أول الوقت أو الأخذ بالمعنى الثاني بالتعجيل قبل الوقت أو بالجمع بين كلا المعنيين، وبعد ذلك استنباط النوعين الرئيسين للتعجيل وهما الكامل بالأسباب والشروط للواجب بلا تراخٍ في الأداء، والتعجيل القاصر بوجود سبب الوجوب وتخلف شرطه وأدائه كما أراده الشارع، أضف لذلك بيان الحكم الشرعي للتعجيل، وعرض عددٍ من الأمثلة الفقهية الدالة على التعجيل، مع بيان أثر الخلافات الأصولية في توضيح أنواع التعجيل.

Abstract

Islamic duties entrusted to a Muslim must be performed as intended by the legislator that achieves the purpose of the legitimate, and by the taxpayer which is bound to speed in compliance or complacency and negligence in the performance. Hurries in the performance of legislation in the views of the fundamentalists has two meanings: duty performance at the first time or before its time, and agreed by the scholars with the difference in the trends of scientists in taking the sense of hurries the first time or taking the latter sense to accelerate ahead of time or a combination of both senses. The second step is eliciting the two main types of hurries with all reasons and conditions for performance without delay; and the restricted hurries due to obigatory condition or failure condition of performance as wanted by the legislator; in addition to stating the hurries legitimate statement. The study has also included a number of relevant jurisprudence examples of hurries and evidence of the effect of contradictions of fundamentalists in explaining the types of hurries in performance.
