الملخص

تعد الإجازة السنوية من أهم الإجازات التي يقر بها المشرع للعامل، ويرجع ذلك لاعتبارات عدة أبرزها الغاية المرتبطة بها، واستحقاقها من العمال كافة، إذ لا يشترط لاستحقاقها سوى إمضاء العامل للمدة في خدمة صاحب العمل، وعلى خلاف الإجازات الأخرى التي يجب لاستحقاقها توافر شروط وظروف معينة. لذلك فقد التفت المشرع إلى أهمية هذه الإجازة فتولى تنظيمها ومعالجة المسائل المتصلة بها، وبما لا يخل بتحقيق التوازن بين العامل وصاحب العمل، إلا أن الواقع يشير إلى أهمية إعادة النظر بهذه الأحكام، بغية الارتقاء بها، وضمان تحقيق هذه الإجازة للغاية المتوخاة منها على احسن وجه. وقد توصلت الدراسة إلى جملة من النتائج والتوصيات، يعد من أبرزها ضرورة إطالة مدة الإجازة السنوية لشرائح معينة من العمال، بالإضافة إلى مراعاة مصلحة العامل الذي تنقطع إجازته بطلب من صاحب العمل، وتخفيف العقوبة المترتبة على قيام العامل بالالتحاق بالعمل لدى صاحب عمل آخر أثناء مدة إجازته.

Abstract

The annual vacation is one of the most important employment vacation recognized by the legislator, for many considerations: specially its purpose; and being deserved for all employees; in difference with other types of permissions, the sole condition to get this vacation is to complete the conditional period of work before demanding it. Thus, the legislator gives attention to this specific important vacation, by organizing and treating its related issues, without loosing the balance between the employee and the employer. In fact, these legislations have to be reviewed, in order to be improved, and to make sure of the best achieving for the attended purpose. This study achieved certain conclusions and recommendations: to prolong the annual vacation for some sectors of employees; to take care of the benefits of the employee to whom the vacation is interrupted by an order from the employer; and to make painless the work for the others while the vacation.
