الملخص

أخذت أدبيات البحث العلمي المعاصرة على عاتقها مطالعة الأبعاد الجديدة المعبرة عن واقع الجريمة في الحقبة الراهنة، وغدت هذه الدراسة واحدة بين تلك التي حاولت كسر الجمود الذي أصاب القاعدة القانونية من خلال نظرة المتشائمين المبنية على عجز تلك التشريعات عن مواكبة الظواهر المستحدثة في شكل الجريمة لا سيما تلك المرتبطة بتقنية المعلومات، إذ هدفت هذه الدراسة إلى بث الحياة في نصوص القوانين القائمة كمحاولة لإثبات قدرتها على استيعاب بعض الأنماط المستحدثة في الجريمة المعلوماتية وذلك بما لا يبرح القول بضرورة إعادة النظر في بعض النصوص بغية التصدي لتلك التحديات التي غدت تتهدد الأمن الجنائي بفعل التطورات غير المسبوقة في تقنية المعلومات.

Abstract

The contemporary literature of scientific research undertook the results of the new sides of crime in the current era, therefore this study became one of those that tried to break the solidity of the legal rule through the view of pessimistic based upon the incapability of these legalization on conveying new-fashioned phenomena s in the crime s form, specifically those related to information techniques. The study aimed to propagate life to the rul texts of laws as an attempt to confirm their ability to understand some of the new-fashioned types in the information crime considering not to review in some texts in order to meet these challenges that became threatening the Penal Security in consequence of the unprecedented development in the information technology.
