الملخص

تبحث هذه الدراسة في أصل من الأصول التشريعية التبعية، وهي الاستحسان من حيث المفهوم والأنواع، ومن قال به من علماء الأصول، وتذكر أدلتهم وأدلة المعارضين له، وتذكر الراجح في ذلك مؤيدا بالأدلة من المنقول والمعقول، كما تذكر فوائد الاستحسان وثماره، وحاجة الاجتهاد والمجتهد لهذا الأصل، وتستعرض تطبيقاته في أحكام المواريث، والتي يستدل من خلالها على أهمية دائرته واتساعها، وأن معظم علماء الفقه والأصول قد قالوا به ولو سمّوْه بغير اسمه.

Abstract

This study investigates one of the fondimentals elements of Sharia (Islamic law) called discretion legal matters, Its concept and types, and their evidence and those who are against. The light is also shedded on the preferred opinion with its proofs and evidences. It also reveals the importance of Istehsan and the need for it all the time, by giving some examples in the subject of inheritance, and indicating the importance of Ijtehad (interpretation judgment), and its influence on scholars.
