الملخص

تتناول هذه الدراسة سلطة القاضي الأردني في الحكم بإحالة الدعوى لعدم الاختصاص الدولي، أو الولائي، أو النوعي، أو القيمي، أو المكاني، ومدى إمكانية تطبيق المادة (112) من قانون أصول المحاكمات المدنية المعدلة بالقانون رقم (12) لسنة 2001م في ضوء النصوص الإجرائية المختلفة بين محاكم الدرجة الأولى النظامية: صلح، وبداية من ناحية، أو فيما بين المحاكم النظامية، والمحاكم التي تتبع جهات القضاء الأخرى من ناحية أخرى. وبيّنا الصعوبات والإشكالات التي تواجه تطبيق نظام الإحالة بين المحاكم الأردنية ، وقد توصلنا، من خلال هذه الدراسة، إلى أن المشرِّع الأردني قد أخذ بنظام الإحالة دون أن يراعي تعديل بعض النصوص القانونية المتعلقة بتوفير الحماية القضائيـة، ليمنع - من خلال تطبيق نظام الاحالة لعدم الاختصاص - المتداعين من الاحتيال على النصوص القانونية المتعلق بالإجراءات أمام المحاكم، خاصة وأن نظام الإحالة يتطلّب تطبيقه وحدة الاجراءات المتبعة لدى المحاكم على مختلف أنواعها.

Abstract

This study deals with the Jordanian judges authority of transferring the case to a competent court as a result of want of jurisdiction on the ground of competence of ratione loci, ratione material, cording to value, judgeship and international. Moreover, this study considers the possible application of article (112) of the Civil Procedural Act, which is amended by the Act No: (12) of 2001, in the light of the procedural articles which differ between the court of first instance and the second instance on one hand, and other courts which belong to other judicature system on the other hand. This study shows the problems and the difficulties which challenge the application of transferring the case to competent courts in the light of the current Jordanian Judicial System. To that fact, this study concludes that the Jordanian legislator did not consider the necessary amendments regarding the judicial protection which would prevent plaintiffs and defendants from avoiding the legal articles relating to judicial procedures before courts. Since, the application of the system of transferring the case to competent courts needs a unity of the procedures under the Jordanian Judicial System.
