الملخص

الحصانة البرلمانية الإجرائية امتياز دستوري يتمتع به عضو البرلمان، لا لشخصه أو لذاته، وإنّما باعتباره ممثلاً للأمة، كي يباشر عمله البرلماني على أكمل وجه. والحصانة البرلمانية الإجرائية لا يجوز التنازل عنها من صاحب الشأن بإرادته المنفردة، وإلاّ حقت مساءلته أمام المجلس النيابي التابع له، كما لا يجوز لهؤلاء الأعضاء من ناحية أخرى، الاحتماء أو الاختفاء وراء هذه الحصانة لإتيان أفعال يحرمها القانون، أو لتحقيق مكاسب غير مشروعة، لأنها شرّعت للمصلحة العامة، وليس للمصلحة الخاصة. لقد أخذ المشرِّع الدستوري الأردني بمبدأ الحصانة الإجرائية بشكل صريح، وبيِّن الأحكام المتعلّقة بها، وذلك في المادة (86) منه. وإن كانت هذه الحصانة ضمانة دستورية هامّة لعضو البرلمان، إلاّ أنها لا ترق إلى إعفاء أعضائه من المسؤولية، أو من العقاب عما يقترفه من جرائم، وإنما فقط تأجيل إجراءات هذه المسؤولية، أو ذلك العقاب- في غير حالة التلبس- حتى يأذن المجلس الذي يتبع له العضو بذلك.

Abstract

The parliamentary procedural immunity is a constitutional privilege enjoyed by a parliamentarian not for his own self but because he is regarded as a representative of the people, so he can continue parliamentary work thoroughly. The procedural parliamentary immunity should not be given up by the person concerned unreservedly, or he may face questioning before the concerned parliamentary assembly. On other hand, and since this immunity was contrasted for the interest of the public and not the individual, members must not protect themselves or hide behind this immunity while doing actions prohibited by the law, or to gain illegitimate advantages. The Jordanian constitutional project adopted the principle of procedural immunity wholeheartedly, and clarified its related acts in Article 86. Though this is an important constitutional safeguard to members of parliaments, it does not amount to relieving members from accountability or retribution for committed offenses ? excluding flagrante delicto case ? even with the permission of the Assembly he belongs to.
